MINUTES <br />CITY COUNCIL <br />APRIL 24, 2013 <br />CUP - <br />3164 RYAN <br />LANE - <br />ROSSOW <br />Blesener opened the Public Hearing to consider the application submitted <br />by Lee Rossow for Conditional Use Permit to allow Major Auto Repair, <br />Over - The -Road Trucking, Body Shop, Towing and Impound, and Outdoor <br />Storage including three storage containers for property located at 3164 <br />Ryan Lane. It was noted that the City Planner and Planning Commission <br />have recommended approval of the CUP subject to conditions outlined in <br />the Planner's report. <br />The City Planner reviewed his April 5, 2013 report noting that the <br />applicant has applied for an amendment to his existing Conditional Use <br />Permit to change some of the uses on the property as well as some of the <br />users of the property. The Planner noted that there is an existing Interim <br />Use Permit allowing outdoor storage at 3164 Ryan Lane by Q3, which is a <br />business on an adjacent site. The applicant is requesting that Q3 be <br />allowed to expand this off-site outdoor storage use into the area previous <br />occupied by an on -site tenant. The next effect is not an expansion of the <br />outdoor storage area, but a transfer of this area to one user. <br />The applicant is also requesting the ability to add three storage containers <br />on the site in an area previously approved for other outdoor storage. The <br />Planner noted that the applicant has not provided detail on the storage <br />containers, but recommended approval subject to compliance with <br />ordinance requirements. <br />The Planner then noted that the applicant has requested an amendment to <br />his CUP to allow a series of potential uses on the property, i.e. Major Auto <br />Repair, over- The -Road Trucking, Body Shop, and Towing and Impound. <br />The Planner then reviewed the recommendations outlined in his April 5th <br />report, recommending approval of the request. He noted modification of <br />his recommendation from tabling to approval of the CUP request for <br />Major Auto Repair indicating that the applicant provided the needed detail <br />at the Planning Commission meeting. <br />Blesener asked if there was adequate outdoor storage space available for <br />the building tenant. The City Planner replied that there is an outdoor <br />storage area identified for Balta's Towing. The Planner again noted that <br />the net result is that the amount of outdoor storage remains the same, the <br />change relates to which business is occupying the outdoor storage areas. <br />Lee Rossow, owner of 3164 Ryan Lane, reported the history of the <br />occupancy of this property. He then reported that the current building <br />tenant, Balta's Towing, was notified by the City that they needed a CUP in <br />order to do major auto repair on the property.
