MINUTES <br />CITY COUNCIL <br />APRIL 24, 2013 <br />therefore, there would likely be a tax impact. He also noted that this <br />concept results in Boog needing the cooperation of Acosta in order to <br />develop his property. The Administrator further commented that Dan <br />Brausen holds fee ownership of the Brausen property in question, but <br />noted that there may be some other documents relative to the sibling's <br />standing with the back portion of the property. The Administrator also <br />pointed out that the back portion of the Brausen property is not a separate <br />parcel of record. <br />Laurie Brausen stated that the City can determine where the road goes <br />given it holds a 50% mortgage on the property. The City Administrator <br />indicated that that was not correct and noted that it would be no different <br />than a bank holding a mortgage on a house. Laurie Brausen stated that she <br />was not suggesting that the City mandate this new concept, she was asking <br />the City to discuss and consider it. <br />Pam Brausen pointed out that past meetings relative to the redevelopment <br />of 2966 Arcade Street focused on bring access in from Arcade Street. <br />Brausen stated that they felt this was in the best interests of the area given <br />it would retain the 33 -foot road easement. Brausen noted the change in <br />bringing road access across from Cherry Hill Lane. The City <br />Administrator acknowledged that the City did play a role in changing the <br />road access to LaBore Road and across from Cherry Hill Lane. He <br />pointed out that bringing the road in from either Arcade Street or via the <br />33 -foot easement at LaBore Road would create corner lots for properties <br />that have not been corner lots. He also indicated that lining up the LaBore <br />Road street access with Cherry Hill Lane is preferable from a public safety <br />standpoint. The Administrator stated that this access became possible <br />when Gordie Howe purchased 2945 and 2959 LaBore Road. <br />Dave Brausen again asked that the City consider his concept plan and <br />create the ability to stub a road in from the Pinetree Pond circle. He <br />indicated that this will assure the Brausen family that they can develop <br />their own property. Brausen stated that the ghost plat leaves their hands <br />tied as development will be dependent on Acosta and Boog. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Keis, seconded by McGraw, the public hearing was <br />closed. <br />Montour asked for staff comments on the Brausen concept presented this <br />evening. The City Administrator indicated that staff has not seen this <br />diagram until now and does not know specific details such as lot sizes, <br />9 <br />
