ORDINANCE NO. 170 <br />AN ORDINANCE AMENDING IN ITS ENTIRETY THE LITTLE <br />CANADA CODE, CHAPTER 1501, LAND FILLING OPERATIONS. <br />THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. That the Municipal Code of Little Canada, Chapter 1501, is <br />hereby amended to read as follows: <br />"1501. LAND FILLING OPERATIONS. <br />1501.010. APPLICATION. Whenever any person or firm proposes to add <br />landfill in excess of 100 cubic yards to any property within the City limits, he <br />shall apply to the City for a Landfill Permit. <br />1501.020. INFORMATION AND FEE. Application as provided in the <br />foregoing Section shall be made to the Clerk of the City upon such form as the <br />Clerk shall provide. The application shall set forth the name and address of <br />the applicant, the address and legal description of the land to be filled, the <br />name and address of the owner of the land, a description of the type and amount <br />of fill material to be placed upon the premises, an estimate of the time <br />required to complete the land fill, a statement that the applicant will comply <br />with all conditions prescribed by the City or its officers or agents. The fee <br />for such application shall be $100.00 to be paid to the City at the time the <br />application is submitted. <br />1501.030. TECHNICAL REPORTS. The Clerk shall, immediately upon receipt <br />of such application, forward a copy thereof to the City Engineer and the City <br />Attorney. These technical advisors shall be instructed by the Clerk to prepare <br />reports for the Council and the Clerk shall state when such reports shall be in <br />his hands for Council consideration. <br />1501.040. ISSUANCE OF PERMIT. Upon receiving information and reports <br />from the Clerk, the Attorney and the Engineer, the Council shall make its <br />determination as to whether, and when, and under what conditions such permit <br />for land fill is to be issued to the applicant by the Clerk. <br />1501.050. RECORDED NOTICE. If such land fill is authorized and <br />undertaken the Attorney shall prepare a legal notice setting forth the <br />description of the property and the kind of fill material being deposited upon <br />the land; and shall file said notice of record in the office of the Register of <br />Deeds or Registrar of Titles of Ramsey County so as to notify all persons who <br />may thereafter examine the title to such property. <br />1501.060. CONDITIONS OF OPERATION. Under no circumstances shall any <br />such land fill operation be conducted or permitted if the contents of the land <br />fill on any part thereof shall consist of garbage, animal or vegetable refuse; <br />poisons, contaminants, chemicals, decayed material, filth, sewage, or similar <br />septic or biologically dangerous material, or any other material deemed to be <br />unsuitable by the City authorities. <br />44.E <br />1 <br />
