ORDINANCE NO. 170 AN ORDINANCE AMENDING IN ITS ENTIRETY THE LITTLE CANADA CODE, CHAPTER 1501, LAND FILLING OPERATIONS. THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the Municipal Code of Little Canada, Chapter 1501, is hereby amended to read as follows: "1501. LAND FILLING OPERATIONS. 1501.010. APPLICATION. Whenever any person or firm proposes to add landfill in excess of 100 cubic yards to any property within the City limits, he shall apply to the City for a Landfill Permit. 1501.020. INFORMATION AND FEE. Application as provided in the foregoing Section shall be made to the Clerk of the City upon such form as the Clerk shall provide. The application shall set forth the name and address of the applicant, the address and legal description of the land to be filled, the name and address of the owner of the land, a description of the type and amount of fill material to be placed upon the premises, an estimate of the time required to complete the land fill, a statement that the applicant will comply with all conditions prescribed by the City or its officers or agents. The fee for such application shall be $100.00 to be paid to the City at the time the application is submitted. 1501.030. TECHNICAL REPORTS. The Clerk shall, immediately upon receipt of such application, forward a copy thereof to the City Engineer and the City Attorney. These technical advisors shall be instructed by the Clerk to prepare reports for the Council and the Clerk shall state when such reports shall be in his hands for Council consideration. 1501.040. ISSUANCE OF PERMIT. Upon receiving information and reports from the Clerk, the Attorney and the Engineer, the Council shall make its determination as to whether, and when, and under what conditions such permit for land fill is to be issued to the applicant by the Clerk. 1501.050. RECORDED NOTICE. If such land fill is authorized and undertaken the Attorney shall prepare a legal notice setting forth the description of the property and the kind of fill material being deposited upon the land; and shall file said notice of record in the office of the Register of Deeds or Registrar of Titles of Ramsey County so as to notify all persons who may thereafter examine the title to such property. 1501.060. CONDITIONS OF OPERATION. Under no circumstances shall any such land fill operation be conducted or permitted if the contents of the land fill on any part thereof shall consist of garbage, animal or vegetable refuse; poisons, contaminants, chemicals, decayed material, filth, sewage, or similar septic or biologically dangerous material, or any other material deemed to be unsuitable by the City authorities. 44.E 1
