Page 2 <br />Since set -back and access /driveway requirements are a vital <br />part of public safety planning and control, we wish to state <br />that we consider the above commitments made at this Hearing <br />to be absolutely necessary conditions for granting any such <br />variances. We request that such conditions be included in any <br />formal action on the proposed formal variance by the Council. <br />SECONDLY <br />The issue was raised by Mayor Hanson and touched upon by Mr. <br />Kath, that there is apparently some ambiguity and /or uncertainty <br />concerning the actual South boundary line of the Kath Brothers <br />property. <br />Woodlynn Ave. is, and has been, a public thoroughfare since <br />before our building was built in 1966 -1967 and it is our under- <br />standing that Ramsey County took over the right -of -way and street <br />several years ago. <br />Woodlynn Ave. is clearly a Public RIGHT -OF -WAY and the specific <br />description of the boundaries should be determined to establish <br />to what lines the Council may wish to grant a variance. Without <br />such determination of actual boundaries, such a variance and <br />resulting building permits would be subject to challenge. We <br />request that as an integral part of such consideration of possible <br />action on the variances, that any ambiguity or uncertainty <br />concerning the Woodlynn Ave. Public Right -Of -Way be resolved. <br />Inasmuch as the above items are of considerable interest to us <br />and represent vital public safety consideration, we request that <br />we be notified of any future Council meetings at which these <br />matters will be taken up, following last nights formal Action to <br />Table. <br />Very truly yours, <br />FUEL ECONOMY CONTRACTING CO ANY <br />J C <br />Preston C.
