ORDINANCE NO <br />158 <br />AN ORDINANCE AMENDING THE LITTLE CANADA CODE, <br />SECTION 703.070. LICENSE CONDITIONS. BY CHANGING <br />THE AGE REQUIREMENT FROM 18 YEARS OF AGE TO 19 <br />YEARS OF AGE IN SUB- PARAGRAPHS (4) AND (6) AND <br />INCLUDING A NEW SUB- PARAGRAPH (9) WHICH PROHIBITS <br />THE SALE OR USE OF CONTROLLED SUBSTANCES ON LICENSED <br />PREMISES AND RE- NUMBERS THE FOLLOWING SUB- PARAGRAPHS <br />(9) AND (10) AS SUB- PARAGRAPHS (10) AND (11). <br />THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. That the Municipal Code of Little Canada, Section 703.070. <br />LICENSE CONDITIONS. be and the same is hereby amended to read as follows: <br />"703.070. LICENSE CONDITIONS. (1) Any act by any clerk, barkeeper, agent, <br />servant or employee of any licensee hereunder, in violation of this Chapter, shall <br />be deemed the act of the employer and license of such place as well as that of said <br />clerk, barkeeper, agent, servant or employee, and every such employer and licensee <br />shall be liable to all the penalties provided for the violation of same, equally <br />with said clerk, barkeeper, agent, servant or employee. <br />(2) Any sale of intoxicating liquor by any clerk, barkeeper, agent, servant <br />or employee made in or from any place duly licensed to sell non - intoxicating malt <br />liquor but not duly licensed to sell intoxicating liquor shall be deemed the act of <br />the employer and licensee, as well as that of the person actually making the sale. <br />and every such employer and licensee of such place shall be liable to all the <br />penalties provided for such sale, equally with the person actually making the same. <br />(3) All sales shall be made in full view of the public. <br />(4) No liquor shall be sold or furnished for any purpose whatever to any <br />person under nineteen (19) years of age or to a habitual drunkard or to one obviously <br />intoxicated or to any person to whom such sale is prohibited by any law of this <br />State or this Chapter. <br />(5) No sale shall be made in any place or in any part of a building where <br />such sales are prohibited by the State Law or this Chapter. <br />(6) No person under nineteen (19) years of age shall be employed in any <br />rooms constituting the place in which intoxicating liquors are sold "on sale ". <br />(7) Every licensee shall be responsible for the conduct of his place of <br />business and shall maintain order and sobriety on the premises, including the <br />parking lot and other areas outside the principle building, after business hours <br />as well as during business hours. <br />(8) No licensee shall keep, possess or operate, or permit the keeping, <br />possession or operation of, on any licensed premises or in any room adjoining the <br />licensed premises, any pinball machine, slot machine, dice, or any gambling device <br />or apparatus, nor permit any gambling therein nor permit the licensed premises or <br />any room in the same or in any adjoining building directly or indirectly under his <br />control to be used as a resort for prostitutes or other disorderly persons. <br />8 <br />
