MINUTES CITY COUNCIL JUNE 14, 2006 that option, and based on a number of issues as outlined in his report, feels that the street could not be constructed ease of the Brausen house in a manner that would meet the City's requirements. The Engineer indicated that based on his review, option one is the best and most feasible method for resolving Mr. Brausen's concerns. However, his office is waiting for verification from Magellen Pipeline about the amount of fill that can be placed over Cheir pipeline. Preliminary indications are that two feet of fill or more will not be an issue. LaValle asked about the lowering of the pipeline. The Engineer reported that the developer has signed a cost sharing agreement with Magellen for the lowering of the pipeline in the area where Preserve Trail will cross it. Magellen will be doing the work with the developer reimbursing costs. The Engineer noted that Magellen will be responsible for their pipeline at all Cimes. The City Administrator agreed that at no time will liability for the pipeline shift away fi•om Magellen. The City Engineer indicated that there will be another meeting on Monday with the developer and Mr. Brausen relative to his review and determination that option one is the only feasible option of the two reviewed.
