the individual subject of that data. Private data on <br />individuals does not include arrest information that <br />is reasonably contemporaneous with an arrest or <br />incarceration. (M.S. 15.162, Subd. 5a.) <br />7. "Confidential data on individuals" means <br />data which is: (a) made not public by statute <br />or federal law applicable to the data and is in- <br />accessible to the individual subject of that data; <br />or (b) collected by a civil or criminal investiga- <br />tive agency as part of an active investigation under- <br />taken for the purpose of the commencement of <br />a legal action, provided that the burden of proof <br />as to whether such investigation is active or in an- <br />ticipation of a legal action is upon the agency. <br />Confidential data on individuals does not include <br />arrest information that is reasonably contempor- <br />aneous with an arrest or incarceration. "Public data not on individuals" means <br />data which is accessible to the public pursuant to <br />M.S. 15.1621. (MS. 15.162, Subd. Se.) <br />10. "Non- public data" means data not on in- <br />dividuals which is made by statute or federal <br />law applicable to the data: (a) not public; and <br />(b) accessible to the subject of the data. "Protected non - public data" means data <br />not on individuals which is made by statute or <br />federal law applicable to the data (a) not public; <br />and (b) not accessible to the subject of the data. <br />(M.S. 15.162, Subd. 5d.) <br />12. "Political subdivision" means any county, <br />statutory or home rule charter city, school district, <br />special district and any board, commission, district, <br />or authority created pursuant to law, local ordi- <br />nance, or charter provision. It includes any non- <br />profit corporation which is a community action <br />agency which <br />any political <br />state agency, <br />performs services under contract to <br />subdivision, statewide system, or <br />to the extent that the nonprofit <br />social service agency or nonprofit corporation col- <br />lects, stores, disseminates, and uses data on indivi- <br />duals because of a contractual relationship with <br />state agencies, political subdivisions, or statewide <br />systems. (M.S. 15.162, Subd. 5.) <br />13. "Designee" means any person designated by <br />a Responsible Authority to be in charge of indivi- <br />dual files or systems containing government data <br />and to receive and comply with requests for <br />government data. (M.S. 15.162, Subd. 10.) <br />14. "Person" means any living individual, part- <br />nership, corporation, association, business trust, <br />or a legal representative of an organization.
