In- <br />formation concerning procedures which re- <br />flect deliberative processes or investigative <br />techniques of law enforcement agencies is <br />CONFIDENTIAL. <br />d Crime victims (PRIVATE with exceptions). The <br />prosecuting attorney of this city shall release <br />investigative data collected by the city's law <br />enforcement agency to the victim of a criminal <br />act or his legal representative upon written <br />request unless the prosecuting attorney reason- <br />ably believes that the release of the data will <br />interfere with the investigation, or that the re- <br />quest is prompted by a desire on the part of <br />the requester to engage in unlawful activities. <br />e. Investigative data (confidential for active <br />investigations). (M.S. 15.162, Subd. 2a). Data <br />collected by a civil or criminal investigative <br />agency as part of an active investigation under- <br />taken for the purpose of the commencement <br />of a civil or criminal legal action is CONFI- <br />DENTIAL. Arrest information that is reasonably <br />contemporaneous with the arrest or incarcera- <br />tion is PUBLIC. <br />- 13 - <br />Criminal records (PRIVAIB). The following <br />criminal records shall not be used, distributed, <br />or disseminated by the state of Minnesota, its <br />agents or political subdivisions in connection <br />with any application for public employment <br />nor in connection with an application for a <br />license: (1) records of arrest not followed by <br />a valid conviction; (2) convictions which have <br />been, pursuant to law, annulled or expunged; <br />(3) misdemeanor convictions for which no jail <br />sentence can be imposed. (M.S. 364.04). <br />Accident records (PRIVAIa All written re- <br />ports and supplemental reports required to be <br />provided to the Department of Public Safety <br />by this section shall be without prejudice to <br />the individual so reporting and shall be for the <br />confidential use of the Department of Public <br />Safety, the Minnesota Department of Trans- <br />portation, and appropriate federal, county, <br />and municipal governmental agencies for acci- <br />dent purposes, except that the Department of <br />Public Safety or any law enforcement depart- <br />ment of any municipality or county in this state <br />shall, upon written request of any person in- <br />volved in an accident or upon written request <br />of the representative of his estate, his surviving <br />spouse, or one or more of his surviving next <br />of kin, or a trustee appointed pursuant to M.S. <br />
