insurance status; medical records when part of <br />personnel data; psychological evaluations; social <br />security numbers; physical limitations; adult <br />criminal history data; references; employee <br />home addresses and telephone numbers; sick <br />leave forms containing doctor's reports; oral <br />interviewer file prior to an applicant's oral exam; <br />exit interview responses; racial and ethnic data; <br />marital status; reference check data as it appears <br />on the employment application; opinion ques- <br />tionnaire responses by potential employees; <br />college transcripts, except for name of institu- <br />tion, degree granted, and date; names of appli- <br />cants for employment until certified as eligible <br />for appointment to a vacancy. <br />Private data on certain individuals. All per- <br />sonnel data maintained by this city relating to <br />an individual employed as or an applicant for <br />employment as an undercover law enforcement <br />officer is PRIVATE data on individuals. <br />2. City attorney (M.S. 15.1694) <br />Notwithstanding the provisions of M.S. 15.162 <br />to M.S. 15.17, the use, collection, storage, and <br />dissemination of data by the city attorney acting <br />in his professional capacity for this city shall be <br />governed by statutes, rules, and professional <br />standards concerning discovery, production of <br />documents, ilntroduction of evidence, and profes- <br />sional responsibility. The provisions of the Minne- <br />sota Government Data Practices Act do not apply <br />to city attorneys. This provision shall not be <br />construed to affect the applicability of any statute, <br />other than M.S. 15.162 to M.S. 15.17, which <br />specifically requires or prohibits disclosure of <br />specific information by the city attorney, nor shall <br />this provision be construed to relieve the Respon- <br />sible Authority, other than the city attorney, from <br />his duties and responsibilities pursuant to the <br />Minnesota Government Data Practices Act. <br />3. Law enforcement data (public, private or <br />confidential) (MS. 15.1695) <br />When collected, created, or maintained by the <br />law enforcement agency of this city: <br />aO. Crime prevention programs (private). Data on <br />participants in crime prevention programs <br />including lists of property with identification <br />numbers or evaluations or recommendations <br />related to structural security against unauthor- <br />ized entry is PRIVATE. <br />bO. Police logs (public, private, or confiden- <br />tial). Data contained on incident complaint <br />reports, variously called logs or dockets, com- <br />prising a chronological record of events, is <br />PUBLIC; however, that data on individuals <br />which could reasonably be used to determine <br />the identity of an undercover agent, informant, <br />or victim of criminal sexual conduct is PRIVATE <br />data on individuals; provided further that any <br />-12- <br />
