Under no circumstance do we <br />recommend that Tract H be left as a nonconforming landlocked parcel. <br />2. A 35 foot strip of land to the west of Tracts E and F (shown on Exhibit B) <br />has not been included on the proposed subdivision although it is part of the <br />total Yorkton Industrial Park property. Similar to proposed Tract H, the <br />developer has indicated that his intention is to sell the strip of land to <br />Buck Blacktop. As with Tract H, it is recommended that this strip not be <br />allowed to be left as a nonconforming landlocked parcel. The developer <br />should either demonstrate that the lard is to be legally combined with the <br />adjoining property or be left connected to Tracts E and F and split off at <br />such time as a sale is confirmed. <br />3. According to the City Clerk, Yorkton Industrial Boulevard from Yorkton <br />Industrial Court southward has not been dedicated to the City. Approval <br />of the subdivision request should include this dedication. <br />4. Yorkton Industrial Boulevard is shown on the proposed subdivision survey as <br />terminating in a deadend The Subdivision Ordinance specifically prohibits <br />deadend streets. Based upon Section 1006.30 (d), a temporary turn arourd <br />should be provided until the road is extended further. This may be done <br />by easement. <br />5. Section 1006.040 of the Subdivision Ordinance requires drainage and utility <br />easements along all property lines. Although all easements ultimately may <br />not be used, it is recommended that the City require these easements as <br />specified by the Ordinance rather than facing possible acquisition at a later <br />date. <br />6. Although we are not familiar with all the details of the previous subdivision <br />approvals for the property, someone has questioned whether an easement for <br />a ponding area to the east of Tract B has ever been acquired. This issue <br />should be addressed by the City Engineer and City Attorney and resolved <br />prior to any further subdivision approval. <br />6 <br />
