Little Canada Mayor and City Council <br />9 February 1981 Page Two <br />It should be noted that although Concept Stage approval constitutes rezoning of the property <br />in question to P.U.D., the Development Stage and Final Plan requirements of the P.U.D. <br />procedures must still be complied with prior to issuance of building permits. It is therefore <br />recommended that a development contract be drafted at this time between the developer <br />and the City. This agreement should include the following items: <br />1. Permitted use of the property - three fourplexes and two duplexes as specified in <br />the preceding paragraphs of this report. <br />2. All lots are to be legally combined as previously discussed and are to be used only <br />as specified above. <br />3. The P.U.D. agreement is to be recorded against the property in question and should <br />run with the land. In this regard, the property may be conveyed to another owner, <br />however, any such new owner is held to the provisions of the agreement. <br />4. The development agreement is for Concept Stage approval only. The owner or future <br />owners must submit Development Stage plans and the Final Plan prior to issuance of <br />building permits. <br />Finally, in order to expedite the processing of the request, it is recommended that the City <br />Council give the City Attorney the authority to draft and exercise the development agree- <br />ment on behalf of the City.
