TYRRELL OF COUNSEL I am representing John Guzik in the matter involving his application for water hook -up to City water in Little Canada. I need not discuss the specifics of this application in view of the fact that Mr. Guzik advised me that you are quite familiar with an application he has made and the denial of that application by the City Council of Little Canada. I have briefly discussed this matter with your City Attorney and he has suggested that I write this letter to you with a copy to him. Following the last City Council meeting regarding this matter, Mr. Guzik has attempted to contact the neighbors for the purpose of obtaining their signatures approving his hook -up to the water main but has been unsuccessful in getting everyones approval. I advised Mr. Guzik that in my opinion the City of Little Canada cannot lawfully delegate to its citizens the power to approve or deny the hook -up to a public water main. Furthermore, it has been brought to my attention that the City Council of Little Canada has approved the hook -up to this same water main by a property at 537 Schletty Drive. That hook -up was allowed only approximately one year ago and after Mr. Guzik bought his property. It only requires a brief research into the law to conclude that Mr. Guzik has a right to hook -up to available City water. 00 Page 2 City Council February 16, 1981 Mr. Guzik fully recognizes that the piece of property that he owns has never been assessed for the improvement caused by this existing water main. In view of the fact that this property has never been assessed, Mr. Guzik agrees that if and when a public water main is installed in front of his property on Schletty Drive, he will agree to be assessed in the same fashion and on an equal basis with other properties adjoining and abutting Schletty Drive. Mr. Guzik has advised me that he has already submitted his application to the FHA for financing for purposes of constructing a home at this address and as part of his application he showed plans and specifications depicting a hook -up to City water. He never anticipated that the City would deny him the right to hook -up to existing water mains. If Mr. Guzik is unable to hook -up to this water main it is quite probable that he will be unable to obtain the necessary financing to construct this house. Mr. Guzik would like to start constructing this home in the spring of 1981 and therefore we would respectfully request that the City of Little Canada take the neces- sary action either in the form of resolution or issuance of a permit to Mr. Guzik so as to allow him to hook -up water to the existing water main on Little Canada Road. If there is any further information that you need on this matter please advise. If and when a City Council meeting is necessary on this matter, please advise Mr. Guzik and myself and we will be present at such a meeting. In examining, very closely the contents of your report, I am prompted to respond with some comments and suggestions. The initial argument of the suburbs in maintaining the present number of courts was the fact that costs of the municipalities would be greatly affected and that it would also be a further burden on the taxpayers of Ramsey County. I simply do not feel that in your brief analysis that you have properly addressed the questions which have been raised by both the municipalities and myself. Let me address issues as I understand them. First, the costs to the municipalities is missing. Secondly, there is no indication as to the revenues derived by the County from the suburban court locations. Third, you do not indicate your rational for the figures which you have quoted. Fourth, there is no cost comparison between costs to the municipalities vs. savings, etc. Finally, there are many line items that you have not supplied at all. It will be difficult to argue a position in favor of reducing the number of courts with the information you have provided and I suggest that perhaps you supply the cost benefit /cost comparison data to the Committee as well as the suburban municipalities prior to the scheduled March 16 Legislative Committee meeting. 17 Page 2 Ronald Bushinski February 25, 1981 I would expect that that data would include the cost to the municipalities in making the necessary adaptations as well as the specific savings to the County when compared to the overall costs. St. Paul, MN 55117 PHONE:484 -2177 or 484 -4538 SECTION I PREPARATION OF CONSTRUCTION PLANS AND SPECIFICATIONS Professional Engineering Services necessary to prepare complete con- struction plans and specifications with which the Owner can secure bids and award a contract. A. BASIC SERVICES 1 Feasibility Report: This report shall include preliminary studies, site inspections, conferences with the Owner, preliminary sketches, cost estimates and recommendations as to the overall feasibility of the proposed improvement. The feasibility report shall comprise twenty percent (20 %) of the basic fee. 2. Plan Survey: The Plan Survey shall include all field survey work necessary to obtain complete and accurate information pertaining to existing surface conditions as needed by the Design Engineer in preparing the construction plans. The Plan Survey shall comprise ten percent (10 %) of the basic fee. -1- 3. Construction Plans: Construction plans shall include detailed working drawings with sufficient sections, elevations and structural details to enable a prospective Contractor to quote or bid a firm price on the work without additional engineering. 4. Construction Specifications: Specifications shall be of sufficient scope to enable a prospective Contractor to quote or bid a firm price based on a set standard of quality, performance and procedure. B. BASIC FEE SCHEDULE The percentage rates shown below shall be considered full compensation for the Basic Services outlined above, for assisting in the taking and tabulating of bids and for reviewing the bids and submitting a recommendation regarding award (See Section II, Paragraph H on Rebidding): a. Less than $20,000.00 per diem rates b. $20,000.00 to $50,000.00 8.5% c. $50,000.00 to $100,000.00 8.0% d. $100,000.00 to $200,000.00 7.5% e. $200,000.00 to $500,000.00 7.0% f. $500,000.00 to $1,000,000.00 6.0% g. $1,000,000.00 and over 5.5% The percentage rates apply to the lowest responsible bid unless a portion of the work on which Engineering Services were performed is deleted by the Owner prior to the taking of bids. If the latter occurs, the percentage rates shall apply to the low bid and the Engineers shall receive additional compensation for services performed on the deleted portion of the work based on the Per Diem -2- 30 rates as set forth in Section II of this Agreement. If alternate or deductive bidding is used, the basic or prime bid shall be considered the highest alternate and the percentage rates shall apply to this figure. C CANCELLATION If any work is cancelled, in whole or in part, the percentage rates shall not apply. The Engineer shall be paid for all work performed up to such time as he is notified in writing of said cancellation, based upon the per diem rates outlined in Section II of this Agreement. SECTION II OTHER PROFESSIONAL SERVICES Certain services as described below may be ordered by the Owner and performed by the Engineer for these services on the basis of an hourly rate as follows: Principal Engineer $ 38.00 Chief Project Engineer 29.00 Project Engineer 25.00 Draftsman 24.00 Registered Surveyor 33.00 Survey Party - 3 Man 65.00 Survey Party - 2 Man 48.00 Clerical 12.00 These rates include all transportation, material, equipment, insurance and overhead. -3- A. CONSTRUCTION SUPERVISION This includes all time spent by the in performing the following tasks: preparing change orders, "as- built" instruction manuals, review of shop details as may be required to carry Engineer after Award of Contract resident supervision, inspection, drawings, periodic pay estimates, drawings, furnishing additional out the intent of the working drawings and checking of the Contractor's invoices and a final review of the work upon Contractor's declaration of completion together with the furnishing of a list of any found deficiencies and omissions and a final certification of completion of the project. B. SURVEYS This includes all time spent by the Surveyor and crews setting construction stakes, performing property surveys (including legal descriptions when required) and resetting monuments destroyed by construction. C. LEGAL This includes all time spent by the Engineer in preparing assessment rolls, preparing depositions, court appearances, litigation and right of any work. D. ADMINISTRATION This includes all time spent by the Engineer in the Administration of grants and loans in work not otherwise necessary except as required by the grantor or lendor. It includes pre - applications, applications, coordination, attendance at meetings, telephone calls, all work associated with public meetings. E. ENVIRONMENTAL This includes all time spent by the Engineer in writing reports, research, preparing for and attending public hearings and other meetings relating to the environment or environmental groups. F. SERVICE BY OTHERS This includes all time spent by the Engineer in advising the Owner and supervising such tasks done by others as the Owner may request or the Engineer may recommend, when authorized by resolution in writing. Such work includes: soil borings and analysis, chemical tests, material tests and other tasks requiring specialized equipment or skills. The advice and supervision by the Engineer shall be paid for at the hourly rates noted above; payment for the actual tasks performed by others shall be paid directly to those persons or firms performing said tasks and not through the Engineer. G. PUBLIC MEETINGS When the Owner requests that the Engineer have a representative at a meeting (specific or all) for advice and counsel in general (not for a specific project) the Owner shall pay the Engineer fifty ($50.00) dollars as full compensation for such time spent at each meeting attended. H. MISCELLANEOUS This includes all time spent by the Engineer in work not otherwise covered above in which the Owner required engineering assistance. This would include plans and specifications not otherwise covered by Section I of this Agreement and investigations or studies of complaints or special conditions where the Owner determines that the Engineer's experience would be useful. SECTION III PAYMENT FOR SERVICES RENDERED A. Statements will be rendered by the Engineer to the Owner each month for any part of work performed to date. Payment shall be due ten (10) days after receipt of this statement by the Owner. B. We have had several accidents there in the past 2 years. The last one sent 3 teen agers to the hospital. One was in serious condition and kept for a week. They ended up out on the lake. I have had 2 experiences myself, where Little Canada Road was extremely slippery after a snow fall and the sanding trucks had not gotten out yet. I slid thru the stop sign and was scared to death I wasn't going to stop before coming to the curve. In the summer, we have a lot of company and kids from the church youth group down for swimming etc. and in the fall they have pow wows. Building sewers shall conform with all utility regulations as to materials, depths of cover slope, and water tightness. No connection shall be covered or other- wise concealed from sight until inspected and approved by the Inspector. Connections Beyond City Limits. The provisions of Section 30.21 shall apply to sewer service outside the corporate limits of Bloomington. Penalty. Any person convicted of violating any of the provisions of this ordinance shall be fined not less than $5.00, nor more than $300.00 or shall be imprisoned for a period not to exceed 90 days. If a violation is of a continuing nature, each twenty -four (24) hour period during which the violation shall continue, shall con - stitute.a separate violation of this Chapter. Enforcement. The water and sewer regulations described in this chapter shall be administered and enforced pursuant to the direction of the City Manager by the Public Works Department of the City. The ruling had the effect of no longer allowing a bank to deduct its cost of paying interest on time deposits it holds for state and local governments, if tax - exempt bond issues were used to secure those deposits. The ruling is scheduled to take effect on May 31, and it is likely to result in state and local governments earning less interest on their deposits, and having to pay higher interest rates on the bonds that they sell. The League of Minnesota Cities as well as the National League of Cities contends that the IRS has erroneously and arbitrarily applied a section of the basic tax law - the Internal Revenue Code of 1954 - to interest paid by banks on deposits of state and local governments. The task in the next few months will be to let your congressman and senators know of the detrimental effect the ruling will have on your city's finances. The resolution was passed on February 23, 1981, effective immediately, and has been accepted by the LMC Board of Directors. Members of the MLOSC Board of Directors present were Matt Kapsch, Mayor, Babbitt, President MLOSC; Willard Vetter, Mayor, Skyline; Mel Kaasa, Mayor, Lake Crystal; Milt Arneson, Mayor, Roseau; Lois Johnson, former Mayor of Badger; and Joyce Griebel, City Clerk- Treasurer, Eagle Lake. All voted in favor of the resolution to sever affiliation with LMC. The decision by MLOSC to drop their affiliation stems from their intention to pursue legislative changes in the local government aid formula. LMC's official policy, adopted by the annual meeting in Duluth last June and reaffirmed by the LMC Board of Directors, is that the LMC will oppose any change in the formula unless that change has been ap- proved through the LMC's policy development process. Guidelines for affiliated organi- zations prohibit such organizations from lobbying for positions contrary to LMC policy, In November 1980, a special League committee on Local Government Aid (LGA) asked MLOSC for suggestions on proposals for the state aid formula as it applies to cities under 2,500 only. In January, MLOSC presented to the committee a formula which would apply to all cities. MLOSC's proposed formula would allocate state aid to each city in pro- portion to that city's population multiplied by its mill rate. Where this formula results in an allocation less than a city currently receives, that city's aid would be frozen at the current level. When this proposed formula was presented to the LMC Local Government Aids committee, the committee members saw several problems with it. A computer run of the proposed formula's results showed that 339 cities would have their aids frozen,; 273, or eight - five percent (85 %) of those cities are under 2,500 population. Cities under 2,500 population as a group would get a smaller share of aids than they do presently. Cities in the Twin City metro area as a group would get a larger share of aids than they do at present. It was also pointed out that since the higher a city's mill rate, the higher the aids, the formula would be perceived as an encouragement to cities to raise their taxes. No projections have as yet been made as to the effect these further changes would have. (For a more detailed explanation of the various problems seen with the MLOSC formula, contact Peggy Flicker at the LMC office.) It was also noted that MLOSC's proposed changes would have no effect unless the total state appropriation for local government aid were increased over last year's level. Since the Governor's budget proposes no increase in funding, the committee's feeling was that cities' lobbying efforts this year should be concentrated on the level of funding as well as the payment schedule and that if cities presented a divided front on the formula question, the legislature would be less likely to approve any funding increase for local government aid and might be likely to make significant formula changes without adequate input from all cities. For these reasons, LMC's Board of Directors decided that the MLOSC proposal could not be adopted and supported by the LMC as the official LMC policy: and that much more study and refinement of the proposed formula would be needed before it could be accepted as LMC policy. The LMC Board has couanitted itself to appoint a League committee repre- sentative of all sizes of cities from throughout the state in June to begin an overall evaluation of the total formula, and develop a unified position on the issue. The LMC Board feels very strongly that cities should resolve their policy differences through LMC's legislative committee process. Through this process, all cities have an opportunity to state their views, to argue for their position and to arrive at a gen- erally agreeable consensus or compromise. Cities are in the best position to get their views accepted in the legislature if they present a united front. When a group of cities chooses not to work within this process and accept its results, but instead to lobby independently for a contrary position, it seriously impairs the effectiveness and credibility of all cities' lobbying. The LMC intends to continue to work with all the cities of Minnesota to develop unified and strong positions on important city issues, including local government aids. [2071.01] [PRESIDE;TIAL PRIMARY,] 9 There shall be held, on the first Tuesday in April of each '^ year in which a president and vice president of the United States are to be nominated and elected, a presidential primary, 12 at which the voters of this state may express their preference 13 among the candidates of the major political party of their 14 choice, for that party's nomination to be president of the 15 United States. For the purposes of sections 1 to 7, "political 16 party" or "party" means a political party as that term is 17 defined in Minnesota Statutes, Section 200.02, Subdivision 7. 18 Sec. 2. (2071.02] [CANDIDATES ON THE BALLOT.] 19 Subdivision 1. The 'following individuals shall be listed 20 as candidates on the appropriate party ticket of the ::1 presidential primary ballot: 42 (a) Anv individual who has announced his candidacy for the 23 nomination of his party to be oresident of the United Staten, 24 excent an individual who has announced himself only as a "native :Si son" candidate or an individual who, in the unanimous opinion of 28 the executive council, clearly is not a'serious contender for 28 1 the nomination; 2 (b) Any individual whose name has been entered as a 3 candidate for the nomination of a political Party in .4 Presidential primaries in two or more other states during the 5 same year; 6 (c) Any individual nominated as a candidate for the 7 presidential nomination of a political party by a petition 8 bearing the names of 2,000 eligible voters from each 9 congressional district; and 10 (d) Any other individual who is the preferred choice of at 11 least five percent of the members of his political party for the 12 presidential nomination of that party as indicated in a national 13 opinion poll or any poll with an established reputation for 14 reasonable accuracy, taken during the six months preceding the 15 date soecified in subdivision 3. The secretary of state shall 16 determine and certify which polls comply with the requirements 17 of this clause. 18 Subd. 2. A tentative determination of the candidates to be 19 listed on the warty ticket of each political party on the 20 presidential primary ballot shall be announced by the secretary 21 of state ten weeks prior to the primary for the purpose of 22 giving voters sufficient time to nominate unlisted candidates by 23 Petition. 24 Subd. 3. The determination of which candidates shall be 25 listed on the residential rimar ballot shall be made b the 26 secretary of state not later than six weeks before the 27 presidential primary. 23 ' Subd. 4. The secretary of state shall notify each 2) individual whose name is to be listed on the presidential 30 primary ballot that his name will be'listed unless the 31 individual submits an affidavit stating that he is not a 32 candidate for the presidential nomination, does not intend to 33 become a candidate, and would not accept the nomination. The 34 affidavit must be submitted to and received' by the secretary of 23 state not later than five weeks before the presidential primary. 26 Sec. 3. (207A.031 [PRESIDDITIIAL PRIMARY; NOW CONDUCTED.] 37 C::ceot as otherwise Provided in sections 1 to 7, the 2 29 1 presidential primary shall be announced, held, and conducted, 2 and the results canvassed and returned in the manner provided by 3 law for other Primaries and in accordance with the general .4 election laws of the state, insofar as they are applicable. If 5 any municipality which customarily uses lever voting machines or 6 an electronic voting system determines that the use of the 7 machines or voting system mould not be practical in the 3 presidential primary, the municipality may use a paper ballot 5 for the presidential primary. 10 Sec. 4. (2071.04] (AUDITOR FURNISHED INFORIAATION BY ' li SECRETARY OF STATE; BALLOT PREPARATION.] 12 Subdivision 1. Prior to February 1 of the year in which a 13 Presidential primary is to be held, the secretary of state shall 14 have a notice delivered to the county auditor of each county 15 advising him of the date of the presidential primary. Each 16 county auditor, on receiot of the notice, shall have a notice of 17 the date of the presidential primary delivered to each town and 18 city clerk in his county. At least 15 days before the date of 19 the presidential primary, each town and city clerk shall post a 20 public notice at his office stating the date and hours during 21 which the polling places in that municipality will be open. 22 Failure to give the notice shall not invalidate the election. 23 Subd. 2. The secretary of state shall prepare paper ballots, absentee ballot envelopes, ballot return envelopes, 23 election return envelopes and summary statements for use in the 26 presidential primary. The ballots shall be printed on white 27 caper with a separate ticket containing the names of the 29 candidates of each political party. 29 Sec. 5. (207A.051 (ENDORSED CANDIDATE.] 30 At the presidential primary each voter may cast one vote 31 for the candidate of his choice. The candidate who receives a 3: plurality of the votes cast for candidates of his political 13 party shall be declared the endorsed candidate of that party. 34 Sec. 6. (2071.06] (SELECTION OF DELEGATES; NATIONAL CO::VE ::TIC:: BALLOTING.] Subdivision 1. The delegates to the national convention of eeach political party appearing on the presidential pri -nr; 3 ballot shall be apportioned among the various candidates of that 2 party receiving votes in the presidential primary, in proportion 3 to their respective vote totals. 4 The secretary of state shall certify to the state chairman ' 5 of each political party appearing on the presidential primary 6 ballot the number of delegates to which each presidential 7 candidate is entitled. 8 Subd. 2. Delegates to the national convention of each 9 political party appearing on the presidential primary ballot 10 shall be chosen by the state convention of that patty, except as 11 oth^rwise provided in this subdivision. The secretary of each 12 party's state convention shall promptly notify the secretary of 13 state of the names of the delegates to the national convention 14 chosen as supporters of each presidential candidate. Only 15 supporters of candidates whose names appeared on the 16 presidential primary ballot may be chosen by the state 17 convention of that party to be delegates to the national 16 convention. The secretary of state shall promptly notify each 15 presidential candidate of the names of the delegates to the 20 national convention chosen as supporters of that candidate. if 21 the presidential candidate determines that the delegates chosen 22 as his supporters by the state convention are not in fact 23 committed to his candidacy, he shall, within ten days of 24 receiving the notification from the secretary of state, advise 25 the secretary of state of the names of those delegates to whom 26 he objects on those grounds and shall name as substitute 27 delegates any other individuals who are committed to his 25 candidacy. The determination and selection by the presidential 26 candidate shall take precedence over.the decision of the state 30 convention and be final. The secretary of state shall promptly notify the secretary of the state convention of the affected __ political party of the action by a Presidential candidate. 32 Subd. 3., At the national convention, delegates chosen 34 because of their support for a presidential'candidate shall vote 35 for that candidate on the first ballot at the national 35 convention regardless of the number of votes he receives, and • 37 shall also vote for him on the second and third ballots if he 1 receives at least 20 percent of the votes cast on the preceding 2 ballot, unless they have been released from that obligation by 3 the candidate. Sec. 7. (207A.07) [USE OF VOTING MACHINES.) 5 The county auditor of each county in which lever voting 6 machines or electronic voting systems are used shall provide all 7 ballots, ballot labels, ballot cards and other necessary printed 6 forms and supplies needed to place the ballots required by 9 sections 1 to 7 on the voting machines which otherwise are 10 provided by the state when paper ballots are used. The total i1 cosr of printing and providing the forms shall be paid by the 12 state. 5
