MEMORANDUM AGREEMENT THIS MEMORANDUM AGREEMENT, made and entered into this day of February, 1981, by and between the CITY OF LITTLE CANADA, a municipality of the State of Minnesota, hereinafter referred to as "City," and A. J. RYAN LANDSCAPE SUPPLY COMPANY, INC., a Minnesota corporation, herein- after referred to as "Owner" or "Builder," both located at Little Canada, Minnesota, WITNESSETH: WHEREAS, builder is the owner in fee simple of and to the following described lands situated in the County of Ramsey, State of Minnesota, to -wit: Lot 7, Block 4, Ryan Industrial Park, and Lot 8, Block 4, Ryan Industrial Park and has Certificates of Title covering said property, true and correct copies of said Certificates of Title are hereto attached and incorporated herein and made a part hereof and marked Exhibits "1" and "2." WHEREAS, the Builder has applied for building permits for the above mentioned two lots, all as appears from the City's File No. 758.09 - 80.29, and WHEREAS, said Builder has proposed to provide a single driveway and the design has been conditionally designated as acceptable by the Planning Conniission of the City, subject, however, to certain conditions, NOW, THEREFORE, for and in consideration of the mutual promises herein contained and for other good and valuable consideration, it is hereby agreed by and between the parties hereto as follows: 1. The Builder does herewith provide the City with a copy of an agreement which will be signed by any future property owners providing for the single driveway for both properties., a true and correct copy of which is hereto attached, incorporated herein, and made a part hereof and marked Exhibit "3." 2. The Builder shall file with the Registrar of Titles and have memorialized upon the Certificates of Title, hereinabove referred to, a copy of this agreement. �f)
