MINUTES
CITY COUNCIL
JUNE 28, 2006
LEE ROSSOW
RESOLUTION NO. 2006-6-146 -CONTINUING THE PUBLIC
HEARING ON THE AMENDMENTS TO CONDITIONAL USE
PERMITS FOR 194/196, 3164, AND 3175 RYAN LANE UNTIL THE
JULY 26, 2006 COUNCIL MEETING AS REQUESTED BY MR. LEE
ROSSOW
The foregoing resolution was duly seconded by Keis.
Ayes (4)
Nays (0). Resolution declared adopted.
PROPERTY Mayor Blesener opened the Public Hearing to consider the request of
COMBINATION - Patricia O'Neil to combine property at 640 LaBore Road and 675
640 LAHORE Keller Parkway into one single-family lot. The City Planner and the
ROAD AND Planning Commission have recommended approval subject to the
675 KELLER conditions outlined in the City Planner's report dated June 5, 2006 and
PARKWAY - subject to the proposed sports court meeting all City Code regulations,
PATRICIA including fencing and lighting regulations. Blesener noted that Mrs.
O'NEIL O'Neil is proposing to construct a sports court on her property that would
be a paved surface with a basketball net.
Dean Hedlund, 655 Keller Parkway, reported that he is happy that Mrs.
O'Neil is proposing to demolish the existing house at 640 LaBore Road
and combine the two properties. Hedlund stated that it is his
understanding that under City Code the sports court could be within 10
feet of his property line. The City Planner replied that that is correct.
Hedlund stated that he would requesC that the sports court be no closer to
his property than where the existing house at 640 LaBore Road is located.
The City Planner noted that the construction of the sports court is not
related to the property combination requesC. Therefore, conditions on Che
sports court would not be appropriately tied to the property combination.
Blesener noted that Mrs. O'Neil indicated at the Planning Commission
meeting that she would place the sports court approximately 56 feet from
the Hedlund property line.
Montour asked if a building permit would be required for the sports court.
The City Planner replied that the paved surface would not require a
building permit provided that the court is located in the rear yard of the
property.
Hedlund asked how much landscaping could be done without a permit.
The City Planner replied that landscaping does not require a building
