MINUTES <br />CITY COUNCIL <br />JUNE 28, 2006 <br />development moves forward, the rate of flow onto adjacent properties <br />cannot be increased. <br />Sculley stated thaC iC is irritating what has happened to his property as the <br />result of poor planning and engineering. He hoped that everyone would <br />be held accountable for future developments. <br />Blesener noted that the Watershed may be changing its regulations this <br />fall, but pointed out that Mr. Johnson has a lot of work to do before his <br />concept can move to Che Preliminary Plat stage. The Administrator stated <br />that he would check with Che Watershed and clarify what is happening. <br />With regard to his proposed outlots, Johnson noted that some of the <br />Maplewood property owners are interested in purchasing these outlots. <br />Blesener questioned why these property owners would spend the money <br />for Chis property when nothing could be built on it. Johnson indicated that <br />they could construct garages on the property. The City Administrator <br />noted that there are issues with properties that cross city boundary lines, <br />and suggested Chat if Maplewood properly owners buy the adjacent LitCle <br />Canada lots, Chere may be the need Co enter into a Joint Powers Agreement <br />with Maplewood to address issues such as property taxes, use of property, <br />etc. <br />Johnson asked why garages could not be built on these outlots. The City <br />Planner noted thaC the City's Zoning Ordinance requires thaC a principal <br />use on a loC, i.e. a house and not just a garage. The Planner agreed that it <br />is likely a joint powers agreemenC will have to be worked out with the City <br />of Maplewood to addresses the issues of property taxes, use, etc. before <br />these outlots could be created and sold to Maplewood property owners. <br />Johnson pointed out that the Maplewood property owners have enjoyed <br />this property for years utilizing it for gazebos, fire pits, hockey rinks, etc. <br />Johnson asked why he could not sell the property to them so they could <br />continue their use of it. <br />Blesener suggested that it may be fine to sell the property to the <br />Maplewood residents, but they may noC be able to build on it. <br />The Administrator stated that if the concept moves forward to preliminary <br />plat, then all these details will be worked out. Johnson asked how long the <br />platting process would take. He again pointed out the Watershed's <br />indication Chat if the property is not platted by September, it may not be <br />able to be developed. <br />
