PAUL, MINNESOTA 55102 <br />As we discussed at length on December 14, 1982, this <br />letter is an attempt to summarize state law relative to over- <br />time compensation for municipal employees. Minn. Stat. <br />Section 177.25, entitled "Overtime ", provides, in part, as <br />follows: <br />Subdivision 1. No employer shall employ any <br />of his employees for a workweek longer than <br />48 hours, unless such employee receives <br />compensation for his employment in excess <br />of 48 hours in a workweek at a rate of not <br />less than one and one -half times the regular <br />rate at which he is employed; provided, <br />however, that an employer if it is the <br />State of Minnesota or a political subdivision <br />may grant time off at the rate of one and <br />one -half hours for each hour worked in excess <br />of 48 hours in any week in lieu of monetary <br />compensation; . . . <br />Since the workweek that has been established for Little Canada <br />employees is 40 hours, the statute quoted above provides for <br />overtime pay for work in excess of 40 hours in a workweek, or, <br />at the option of the City, the City may grant compensation <br />time to the employee.
