The policy is also that there is no <br />accumulation of compensation time beyond December 31st of each <br />year. <br />Time worked by City personnel may be exempt from the <br />overtime wage provisions if the employer determines that the <br />employee's primary duties meet all of the criteria of a <br />particular test set forth in Section 1.4015 of the Labor <br />Standards of the Minnesota Department Of Labor And Industry, <br />a copy of which is enclosed for your review. It is my under- <br />standing that the City has not previously determined that time <br />spent by any employee is exempt from the overtime wage provisions. <br />In direct response to Roger Glanzer's request at the <br />meeting of December 8, 1982, the City Council has the authority <br />to pay for overtime in cash or in compensation time off, or <br />a combination of both. It is also possible that the employer <br />consider the employee to be exempt from the overtime wage <br />provisions, if the employee's primary duties meet all the <br />criteria of a particular test, as set forth in the Labor <br />Standards. <br />Would you please review the enclosed and submit the same <br />to the Council for their consideration. <br />Yours very truly, <br />SWEENEY, O'CONNOR & LEMAY <br />Thomas M.
