PREQLEARY <br />916. "FP ", FLOOD PLAIN DISTRICT <br />916.010. PURPOSE. The intent of this Section is to provide for the pro- <br />tection and preservation of water channels and those portions of the adjoining <br />flood plains which are reasonably required to carry and discharge a regional flood <br />and are subject to inundation by regional floods. (Regional flood shall be defined <br />according.to standards established by the Minnesota Department of Natural Resources <br />and illustrated on the Little Canada Flood Insurance Rate Maps (FIRM) effective 3 <br />November 1982.) It is the intent of this district to be applied to those areas <br />which, if left unrestricted, could result in loss of life and property, health <br />and safety hazards, disruption of commerce, utilities and governmental services, <br />extraordinary public expenditures for flood plain protection and relief and impair- <br />ment of the tax base, all of which adversely affect the public health, safety and <br />general welfare. This district is furthermore created and applied in compliance <br />with requirements of Minnesota Statutes, Chapters 104 and 462 as amended. In <br />addition, Minnesota Regulations N.R. 85, as may be amended, shall be consulted <br />in administering and applying this district. <br />916.020. WARNING AND DISCLAIMER OF LIABILITY. This Section does not imply <br />that areas outside the "FP ", Flood Plain District boundaries or land uses allowed <br />within this district will be free from flooding or flood damages. This Section <br />shall not create liability on the part of the City of Little Canada or any officer <br />or employee thereof for any flood damages which result from reliance on this <br />Ordinance or any administrative decision lawfully made thereunder. <br />916.030. DISTRICT APPLICATION. The "FP ", Flood Plain District shall be <br />applied to and superimposed upon all districts as existing or amended by the text <br />and map of this Ordinance. The regulations and requirements imposed by the "FP ", <br />Flood Plain District shall be in addition to those established by all other districts <br />of this Ordinance. The "FP ", Flood Plain District shall be established based upon <br />the specific information contained in the Flood Boundary, Floodway and Flood <br />Insurance Rate Maps and the Flood Insurance Study for the City of Little Canada. <br />All aforementioned official maps and documents are hereby adopted by reference <br />and declared to be an integral part of this Ordinance. <br />916.040. FLOOD PLAIN SUBDISTRICTS. The area within a Flood Plain District <br />is further divided into floodway, flood fringe, and general flood plain. A flood - <br />way includes the channel of a river or stream and those portions of the adjoining <br />flood plain which are required to carry and discharge the regional flood. A <br />flood fringe includes the area outside of the floodway, but subject to inundation <br />by the regional flood. The general flood plain shall include those areas designa- <br />ted as unnumbered A Zones on the Flood Insurance Rate Map. <br />916.050. RULES FOR INTERPRETATION OF DISTRICT BOUNDARIES. The boundaries <br />of the Flood Plain District shall be determined by scaling distances on the Official <br />Zoning Map. Where interpretation is needed as to the exact location of the boundaries <br />of the District as shown on the Official Zoning Map, as for example, where there <br />appears to be a conflict between a mapped boundary and actual field conditions, the <br />City Engineer shall make the necessary interpretation. The person contesting the <br />location of the District boundary shall be given a reasonable opportunity to pre- <br />sent his case and to submit his own technical evidence if he so desires. <br />o t <br />
