916.080. PERMITTED USES. Uses having a low flood damage potential and not <br />obstructing flood flows shall be permitted within the "FP ", Flood Plain District <br />to the extent that they are not prohibited by any other ordinance and are allowed <br />within all districts which jointly apply, and provided they do not require structure, <br />fill, or storage of materials or equipment. In addition, no use shall adversely <br />affect the capacity of the channels, or floodway of any tributary to the main stream, <br />drainage ditch or any other drainage facility or system. Permitted uses are limited <br />to the following: <br />A. Agricultural uses such as general farming, pasture, grazing, outdoor <br />plant nurseries, forestry, horticulture, truck farming, sod farming, <br />and wild crop harvesting. <br />B. Residential: lawns, gardens, parking areas, docks, piers and play <br />area. <br />C. Industrial - Business: Loading areas and parking areas. <br />D. Public and private recreational uses. <br />916.090. CONDITIONAL USES. Requires a conditional use permit based upon <br />procedures set forth in and regulated by Section 921 of this Ordinance. In addi- <br />tion, the City Engineer shall determine whether the proposed conditional use <br />location is within a floodway or flood fringe area. Upon such determination, <br />the applicable conditions, provisions and restrictions shall be imposed. The <br />Commissioner of Natural Resources shall be given at minimum ten (10) days notice <br />of the required public hearing and shall be advised in writing of decisions made <br />concerning any conditional use. <br />A. Floodway. <br />1. The following open space uses require accessory structures <br />;(temporary or permanent), or fill or storage of materials or <br />equipment. These uses may be permitted in the Floodway <br />District only after the issuance of a Conditional Use Permit: <br />a. Uses or structures accessory to open space or conditional <br />uses. <br />b. Extraction of sand, gravel, and other materials. <br />c. Marinas and water control structures. <br />d. Railroads, streets, bridges, utility transmission lines, <br />and pipelines. <br />e. Storage yards for equipment, machinery, or material. <br />f. Placement of fill. <br />2. Standards for Floodway Conditional Uses. <br />a. No structure (temporary or permanent), fill (including fill <br />for roads and levees), deposit, obstruction, storage of <br />materials or equipment, or other uses may be allowed as a <br />conditional use which, acting alone or in combination with <br />existing or anticipated future uses, adversely affect the <br />capacity of the floodwav_ or increases flood heights. Con- <br />
