sideration of the effects of a proposed use shall be based upon <br />the reasonable assumption that there will be an equal degree <br />of encroachment extending for a significant reach on both sides <br />of the stream. All conditional use applications shall be accom- <br />panied by a floodway impact statement drafted by a registered <br />engineer. The Zoning Administrator snall be responsible for <br />submitting the proposal and application to the Department of <br />Natural Resources and any other governmental unit having <br />jurisdiction over the area for review and comment. <br />b. Fill. <br />(1) Any fill deposited in the floodway shall be no more <br />than the minimal amount necessary to conduct a Con- <br />ditional Use. Generally, fill shall be limited to <br />that needed to grade or landscape for that use and <br />shall not in any way further obstruct the flow of <br />flood waters. <br />Spoil from dredging or sand and gravel operations shall <br />not be deposited in the floodway unless it can be done <br />in accordance with (1) above. <br />Such fill or other materials shall be protected against <br />erosion by rip -rap, vegetative cover, or bulkheading. <br />c. Structures. <br />(1) Structures shall not be designed for human habitation. <br />(2) Structures shall have a low flood damage potential. <br />(3) Structures, if permitted, shall be constructed and <br />placed on the building site so as to offer the minimum <br />obstruction to the flow of flood waters. <br />(a) Whenever possible, structures shall be constructed <br />with the logitudinal axis parallel to the direc- <br />tion of the flood flow, and <br />(b) So far as practicable, structures shall be placed <br />approximately on the same flood flow lines as <br />those of adjoining structures. <br />(4) Accessory structures shall be floodproofed in accor- <br />dance with the State Building Code. <br />d. Storage of Material and Equipment. <br />(1) The storage or processing of materials that are in <br />time of flooding buoyant, flammable, explosive, or <br />could be injurious to human, animal, or plant life, <br />is prohibited. <br />
