AGREEMENT This Agreement made this day of , 1982, by and between the City of Little Canada, a Minnesota municipal corporation ( "the City "), and Tex -Sota Construction, Inc., a Minnesota corporation ( "Tex- Sota "). WHEREAS, Tex -Sota is the contract for deed vendee of certain property consisting of approximately 11.32 acres, exclusive of platted roadways, located in the City, in Ramsey County, Minnesota, legally described as follows: Lot 24, and the East 519.0 feet of Lot 23, except the South 180 feet of the West 125 feet of the East 459.0 feet of Lot 23, J.F. Eisenmengers Garden Lots, subject to easements, restrictions, and covenants of record and that part taken for highway purposes; and • That part of the West 1/2 of the Southeast 1/4 of Section 7, Township 29 North, Range 22 West, lying West of the Westerly line of the Minneapolis, St. Paul, and Sault Ste. Marie Railway right of way as now established, and South of the Southerly line of State Highway No. 36 as now established. Subject to the rights of the public in County Road B and Courtland Street, and subject to the rights of the Minneapolis, St. Paul, and Sault Ste. Marie Railway Company and State of Minnesota to erect temporary snow fences; (hereinafter the "Property "); and WHEREAS, Tex -Sota intends to develop a mini - storage facility and office building upon the westerly portion of said Property; and WHEREAS, the City, as well as the State of Minnesota, is desirous of develop- ment of a ponding area consisting of approximately 2.62 acres, exclusive of platted roadways, to serve City streets, County roads, and State Trunk Highway No. 36, on a portion of said property described as follows: That part of Lot 24 and the East 519 feet of Lot 23, J.F. Eisenmengers Garden Lots, according to the plat thereof on file and of record in the office of the County Recorder in and for Ramsey County, Minnesota; excepting therefrom the South 180 feet of the West 125 feet of the East 459 feet of said Lot 23; which lies easterly of Line I described below:
