Sept. 22, 1982
T0: City Council
FROM: Ed Locke
RE: Filling at 2889 & 2901 Payne Ave.
The land fill ordinance states that 100 cubic yards or less does not need
a permit. Ch. 70 of the.UBC states that "No person shall do any grading
without first having obtained a grading permit from the Building Official,
except for the following:
9. " A fill less than Lfoot in depth and placed on natural terrain with
a slope flatter than five horizontal to one vertical, or Less than 3 feet
in depth, not intended to support structures, which does not exceed 50
cubic yards on any one lot and does not obstruct a drainage course."
In review of the ordinance, a permit is needed for over 100 cubic yards
of fill. The amount of fill hauled onto the lots is around 100 cubic
yards per lot. No building is planned to be built on the fill. The
fill is less than 3 feet in depth. Also, taking into consideration the
fact that Payne Ave. is built higher than all the land, the Council and
Engineer approved of the drainage and site plans and determined that a
land fill permit was not needed. I met with Ewald Seise at the site and
from the looks of the rough grading the swail was installed by Mr. Garske,
and everything was in order.
On Sept.22, 1982, Ewald inspected the swail for drainage. The Engineer
will decide if it is acceptable.
_'. H
