ANIMAL CONTROL SERVICE CONTRACT THIS AGREEMENT, made and entered into this day of , 19 , by and between WHITE BEAR ANIMAL CONTROL, INC., a Minnesota corporation, hereinafter referred to as "WBAC, Inc. ", and CITY /TOWN OF Little Canada a municipal corporation, Ramsey County, Minnesota, hereinafter referred to as "CiEy /Town ". WITNESSETH: That WBAC, Inc. in consideration of the cove- nants and agreements of said City /Town, hereinafter contained, hereby covenants with said City /Town that the WBAC, Inc. will provide Animal Control Service to said City /Town as follows: 1. Patrol the public and private streets of City /Town in a vehicle appropriate to the transportation of small animals part of each day, five (5) days a week, and emergency call -up standby service on a twenty -four (24) hour basis on the specific request of the City /Town or County Sheriff's Department, and pick up and impound dogs and other animals found running at large or otherwise in violation of City /Town Ordinances. 2. That patrolling shall be performed by competent adult personnel trained in the handling of animals, WBAC, Inc. agree- ing to appoint sufficient animal control officers to provide the service agreed to under this contract. That such personnel shall be approved by the City/Town's Council /Board at the City /Town's request. 3. Equip, service and maintain in all vehicles used for patrol service. two -way radios and /or other communication equip- ment to provide communication with the County Sheriff's Department. 4. That all animals taken up will be impounded at the Animal Shelter at 1281 Hammond Road, Town of White Bear (Township), Minnesota and there confined in a humane manner for a period of not less than five (5) business days, and may then. after be dis- posed of in a humane manner, subject to Minnesota Statutes Section 35.71, Subd. 3, if not claimed by their owners. Dogs and other animals not claimed by their owners before the expiration of five (5) business days shall become the property of WBAC, Inc. and disposed of at the discretion of WBAC, Inc. subject to Minnesota Statutes. 5. Unless otherwise provided by City /Town Ordinances, and upon proof of compliance with City /Town Ordinances, any animal impounded hereunder may be reclaimed upon payment by the owner to WBAC, Inc. or its agent, of the impoundment fee of $2.5.00 and a boarding fee of $5.00 Per day, which fee shall be retained by WBAC, Inc. In addition thereto, said owner shall pay for emergency medical treatment provided by a licensed veterinarian when ordered as deemed necessary by WBAC, Inc. The Animal Shelter facilities
