The word "maintain" as used herein shall be construed as preserving the aforesaid frontage road, as nearly as practicable, in its original condition, including but not limited to minor patching and repairing, the removal of snow, ice and debris from said road, applying sand, cinders or salt as necessary, and mowing vegetation within the portions of the right of way as required, but shall not be construed to include any resurfacing or heavy seal coating which determination of need and the cost and expense of such shall be the sole responsibility of the State. III The County indemnifies, saves \ td holds harmless the State and all of its agents and employees from any and all claims, actions or causes of action of any Lind or nature whatsoever arising out of or by reason of the maintenance work pro- vided for herein to be performed by the County and further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of assert- ing any c1A1m of any nature or kind arising out of said maintenance work.,. N All employees of the County and all other employees while engaged in said maintenance shall not be considered employees of the State and all claims that may arise under the Workmen's Compensation Act of the State of Minnesota on behalf of said employees while so engaged and any claims made by any third parties as a conse- quence of any act or omission on the part of said .employees while so engaged on said maintenance shall in no way be the obligation or responsibility of the State and tho County holds the State harmless from any and all such claims.
