YO I)'11l BROADWAY <br />WAYZATA, MINNESOTA 1i 5391 <br />July 8, 1982 <br />Re: City of Little Canada <br />Development of Mini - Storage Facility <br />Dear Mr. Sweeney: <br />TELEPHONE <br />(,12) 4/5 -343`i <br />imp <br />Jut 12 1982 <br />CITY OF <br />LITTLE CANADA <br />Pursuant to our telephone conversation, enclosed please find copies of title <br />opinions prepared by our office for our client, Tex -Sota Construction, Inc., who <br />purchased the property described therein from Naegele, Inc., pursuant to a Contract for <br />Deed dated May 18, 1982, a copy of which is also enclosed. Also enclosed please find a <br />copy of paragraph 3 of the Purchase Agreement between the parties, referred to in <br />paragraph 15 of the Contract for Deed, which outlines the contemplated exchange of <br />properties and includes Naegele's agreement to cooperate therein. The Contract for <br />Deed has been recorded with the Ramsey County Recorder as Document No. 553631. A <br />Satisfaction of the Mortgage noted at paragraph 1 of each title opinion has also been <br />recorded, and I enclosed a copy thereof. Finally, I am enclosing a copy of the map <br />drawn by the State of Minnesota, Department of Transportation, showing the parcels <br />involved. <br />The City's participation in this aspect of the project would be as follows: <br />1. Our client has purchased from Naegele, Inc. all of the property shown on <br />the enclosed map, excluding the right of way of Trunk Highway No. 36, and excluding <br />the triangular shaded piece (Parcel 1) abutting Lot 24 to the north. The City must first <br />vacate Rosedale Avenue and Courtland Street (Jackson Street), so that title thereto <br />reverts to the abutting landowners. <br />2. Our client and Naegele, Inc. will then deed the ponding area, represented <br />by the shaded portion on the right -hand side of the map (Parcel 2) to the City of Little <br />Canada, in consideration for the City's ultimate conveyance of Parcel 1 to our client (or <br />Naegele, Inc., if the Contract for Deed is still outstanding). <br />3. The City will develop descriptions for the easements they wish to reserve <br />over the ponding area, which I understand to include a sewer easement, a utility <br />substation, and a single lane access leading from a private road to be constructed by our <br />client to the east of Parcel 2. <br />
