811.070. INCONSISTENCIES WITH OTHER ORDINANCES. Whenever any <br />provisions of this ordinance are inconsistent with the provisions of other <br />parts of the Little Canda Code, such as Section 1202.010 governing curfew <br />hours, the provisions herein shall supersede such other inconsistent <br />provisions. <br />811.080. PENALTIES. Every person convicted of a violation of this <br />ordinance shall be punished by a fine of not more than Three Hundred Dollars <br />($300.00) or by imprisonment for a period of not more than ninety (90) days, <br />or both, and in either case the costs of prosecution may be added. <br />(Source: Ord. 137) <br />812. LICENSING OF TREE REMOVAL CONTRACTORS. <br />812.010. LICENSE REQUIRED. No person shall fell, cut, trim, or <br />remove any tree for hire within the City, the branches of which are two or <br />more inches thick at the point of severance, without a license. <br />812.020. APPLICATION. Applications for such license shall be filed <br />with the City Clerk. The application shall contain the name and address of <br />the applicant; whether the applicant is an individual, partnership or <br />corporation; and the make, style and number of trucks or other vehicles to be <br />used by the applicant in the business of tree trimming or hauling. The <br />license fee required by this Chapter shall accompany the application and a <br />receipt therefor shall be attached to the application. In addition, a policy <br />of insurance required by this Chapter shall be attached to said application. <br />812.030. LICENSE FEE. The license fee shall be Thirty Five Dolars <br />(835.00) per year. <br />812.040. INSURANCE. Each licensee shall file with the City Clerk an <br />insurance policy issued by an insurance company authorized to do business in <br />the State of Minnesota. Said policy shall insure the licensee in the sum of <br />at least Twenty Five Thousand Dollars (825,000.00) against liability imposed <br />by law on account of bodily injury or death of any person or persons not <br />covered by Workmen's Compensation Law, and in the sum of at least Ten Thousand <br />Dollars (810,000.00) against liability imposed by law on account of damage to <br />or destruction of property, in connection with the felling, cutting, trimming <br />or hauling of trees for hire. The policy shall be endorsed to provide that it <br />may not be cancelled by the carrier except upon a ten (10) day written notice <br />to the City Clerk. In the event such insurance is so cancelled and the <br />licensee shall fail to replace the insurance with a substitute policy, his <br />license shall be automatically suspended until proof of such insurance shall <br />be provided to the City Clerk. <br />9 <br />
