April 20, 1982 <br />TO: Tom Curley, Chairman <br />North Suburban Cable Commission <br />FROM: Jim Andre, City Manager <br />SUBJECT: Joint Powers Agreement to Administer Cable TV Franchise <br />At its regular meeting on March 8, the Roseville City Council reviewed a <br />draft (k3) of a Joint Powers Agreement for administering the North <br />Suburban Cable franchise. <br />The City Council has several areas of concern as it relates to the draft <br />agreement. <br />1. Part V, Section 1 provides that any municipality contiguous to any <br />of the member cities, may become a member. Roseville's concern <br />relates to the potential admission of either one of the two central <br />cities, which are both contiguous to Roseville. <br />2. Part VI, Section 2 provides that each city shall appoint a director <br />as its representative on the Commission. Roseville's position is <br />that the director's appointments be restricted to elected and <br />appointed city officials from each of the member cities. The <br />reason for this position is the kinds of decisions the Commission <br />is generally charged with under the agreement, and how they may <br />affect public funds and budgets. <br />3. Part VI, Section 6 provides for what constitutes a quorum of the <br />directors. Roseville suggests that language be considered which <br />provides for a method of notifying all members of a meeting. <br />4. Part X provides that all revenues remain with the Commission. <br />Roseville's position is that all franchise fees legitimately <br />due each city be remitted directly to each City; and the <br />Commission be required to submit their budget and work programs, <br />if any, to the member cities. The cities would remit their <br />individual financing shares of the agreed upon budget, to the <br />Commission. The franchise fee could potentially involve large <br />sums of monies. It is also unclear, at this time, for what <br />purpose these funds would be expended. <br />The Roseville City Council respectfully requests the North Suburban Cable <br />Commission to give thoughtful and serious consideration to the above concerns. <br />cc: T.
