WAIVER OF RIGHT TO APPEAL FROM SPECIAL ASSESSMENT OF
<br />LITTLE CANADA IMPROVEMENT PROJECT 81 -11
<br />The undersigned, Peterson Maintenance Corporation, a Minnesota
<br />corporation, is the owner of a contract vendee's interest in the
<br />following described property, located in the City of Little Canada,
<br />County of Ramsey, State of Minnesota, which is described on Certificate
<br />of Title No. 283649, as follows:
<br />Lot 3, Block 1, Ryan Industrial Park.
<br />The undersigned understands that A.J. Rvan Landscape Supply
<br />Company, Inc., has agreed that the estimated cost of a street im-
<br />provement, which is part of Little Canada Improvement Project 81 -11
<br />is $17,000.00, one -third of which is to be assessed against Lot 3,
<br />Block 1, Ryan Industrial Park. The assessment shall be amortized over
<br />a 15 year term, pursuant to Minn. Stat. Chapter 429.
<br />The undersigned will 'receive Notice of a Special Assessment
<br />Hearing for Little Canada Improvement Project 81 -11 as to Lot 3,
<br />Block 1, Ryan Industrial Park, which hearing will be held by the
<br />Little Canada City Council in the fall of 1982, at Little Canada
<br />City Hall. -
<br />The undersigned, and its successors and assigns, hereby
<br />stipulates and agrees that the special assessment of $5,667.00
<br />against Lot 3, Block 1, Ryan Industrial Park, is reasonable and is
<br />based upon, and does not exceed the benefits received by the subject
<br />property by reason of Little Canada Improvement Project 81 -11.
<br />The undersigned, and its successors and assigns, hereby
<br />stipulates and agrees that the special assessment of $5,667.00
<br />will be levied against the subject property, and will constitute
<br />a' lien on the subject property, in accordance with Minn. Stat.
<br />Section 429.061.
<br />The undersigned, and its successors and assigns, hereby
<br />stipulates and agrees that any right to appeal from the special
<br />assessment of $5,667.00, pursuant to Minn. Stat. Section 429.081,
<br />is waived in all respects and in all events.
