WAIVER OF RIGHT TO APPEAL FROM SPECIAL ASSESSMENT OF
<br />LITTLE CANADA IMPROVEMENT PROJECT 81 -11
<br />The undersigned, Roger D. Stanke and Judith Ann Stanke; husband
<br />and wife, are the owners of the following described real property,
<br />located in the City of Little Canada, County of Ramsey, State of
<br />Minnesota, Certificate of Title No. 285801, which is described as
<br />follows:
<br />Lot 1, Block 1, Ryan Industrial Park.
<br />The undersigned understands that A.J. Ryan Landscape Supply
<br />Company „Inc., and the City of Little Canada have agreed that the
<br />estimated cost of the watermain improvement described as Little
<br />Canada Improvement Project 81 -11 is $9,000.00, which shall be
<br />assessed against Lot 1, Block 1, Ryan Industrial Park, Lot 1, Block 3,
<br />Ryan Industrial Park, and Lot 5, Block 3, Ryan Industrial Park. The
<br />assessment shall be amortized over a 15 year term, pursuant to Minn.
<br />Stat. Chapter 429.
<br />The undersigned will receive Notice of a Special Assessment
<br />Hearing for Little Canada Improvement Project 81 -11 as to Lot 1,
<br />Block 1, Ryan Industrial Park, which hearing will be held by the
<br />Little Canada City Council in the fall of 1982,_at Little Canada
<br />City Hall.
<br />The undersigned, and their successors and assigns, hereby
<br />stipulate and agree that the special assessment of $3,000.00
<br />against Lot 1, Block 1, Ryan Industrial Park, is reasonable, and
<br />is based upon and does not exceed the benefits received by said
<br />property by reason of Little Canada Improvement Project 81 -11.
<br />The undersigned, and their successors and assigns, hereby
<br />stipulate and agree that the special assessment of $3,000.00 will
<br />be'levied against the subject property, and will constitute a lien
<br />on the subject property, in accordance with Minn. Stat. Section
<br />429.061.
<br />The undersigned, their successors and assigns, hereby
<br />stipulate and agree that any right to appeal from a special assess-
<br />ment of $3,000.00, pursuant to Minn. Stat. ion 9 /081, is
<br />waived in all respects and in all events y
