NORTHWEST ASSOCIATED CONSULTANTS INC. <br />MEMORANDUM <br />TO: Little Canada Planning Commission, Mayor <br />and City Council <br />FROM: Brad Nielsen <br />DATE: 30 April 1982 <br />RE: Gervais Creek Office Building - Conditional Use <br />Permit for a Planned Unit Development <br />FILE NO: 758.09 (81.34) <br />BACKGROUND <br />In January of this year, Mr. Thomas Krejci applied for a rezoning and con- <br />ditional use permit to convert the old Little Canada Elementary School to <br />office use (see our staff report, dated 29 January 1982). Prior to the <br />meeting at which the request was to be heard, Mr. Krejci asked that the <br />C.U.P. be tabled pending some modification to his plans. The rezoning <br />from the P District to the R -B District has since been approved by both <br />the Planning Commission and City Council. <br />Mr. Krejci has now resubmitted his request for a conditional use permit. <br />The request now involves a subdivision of the property in order to convey <br />part of the site to another owner (see Exhibit A), without whose financial <br />contribution the project would be unfeasible at this time. Since the lot <br />division would also divide the building, creating a zero lot line situation, <br />the applicant has taken a planned unit development approach. Mr. Krejci has <br />submitted an outline of the proposed development, a copy of which is attached <br />to the back of this report. <br />ISSUES AND ANALYSIS <br />Section 909.040 H. of the Little Canada Zoning Ordinance allows commercial <br />planned unit development by conditional use permit within the R -B District. <br />While such a P.U.D. would normally be used for new development, we have no <br />objection to the applicant's use of P.U.D. to accomplish the lot division. <br />In approving the P.U.D., however, it is recommended that the City address <br />a number of issues and require certain assurances regarding such things as <br />maintenance, use of the property, park dedication, utility service, etc. <br />These items should all be covered in a development agreement between the <br />developer and the City.
