The applicant has changed the proposed use of the building some -. <br />what, requesting that the downstairs portion of the building be used as <br />a rental hall. Various opinions have been expressed by the Council and <br />the Planning Commission as to the need and the desirability of a rental <br />hall for this site. Since rental halls are not included within the R -B <br />District as permitted or conditional uses, the Ordinance would have to be <br />amended to accommodate such a use. <br />We were directed to prepare a report and draft amendment for study by the <br />Planning Commission and Council. In reviewing this amendment, the City <br />must consider adequacy of parking, sale of liquor, etc. These items will <br />be addressed in a separate report. <br />In preparing the P.U.D. agreement, the City should specify acceptable uses <br />of the building. If other uses are requested later, they should be subject <br />to conditional use procedures prior to approval. <br />2. Structure Upkeep /Maintenance. The applicant has indicated that an owners <br />agreement will be formulated and signed by both present and future owners. <br />It will contain provisions for maintenance and upkeep of the structure and <br />grounds. While we do not suggest that the City dictate what the appearance - <br />of the structure should look like, we feel it is in the City's best interest <br />to provide for consistency within the structure and the site. In this <br />regard, the overall character of the structure should be maintained. <br />The City should review the applicant's ownership agreement. If acceptable <br />in terms of the preceding concerns, it should be attached as addendum to <br />the agreement between the developer and the City. <br />3. Utility Service. Since ownership of the site will be divided, the City <br />Engineer should comment as to utility service to the building, specifically <br />whether separate utilities are necessary. <br />4. Park Dedication. Little Canada Ordinance No. 172 requires park dedication <br />for projects involving subdivision of land. Under the terms of the <br />Ordinance, the City can require either 10% of the land,or cash in lieu <br />of land in the amount of 10% of the fair market value of the undeveloped <br />land. <br />An existing tennis court on the site has been a topic of discussion in <br />the review of this project. While Mr. Krejci does not wish to dedicate <br />the court, he is willing to enter into a long term lease agreement with <br />the City which would enable City residents to continue using the court. <br />21 <br />
