ORDINANCE NO. 172 <br />AN ORDINANCE AMENDING THE LITTLE CANADA CODE <br />BY CONFORMING THE PARK AVAILABILITY CHARGE <br />PROVISIONS TO STATE STATUTES. <br />THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. Chapter 2101 of the Municipal Code of Little Canada, is <br />hereby amended to read as follows: <br />"2101. PARK AVAILABILITY CHARGES. <br />2.101.010. PURPOSE. This ordinance is enacted to provide for orderly, <br />economic and safe development of land and urban services and facilities, and to <br />protect and promote the public health, safety and general welfare of the <br />inhabitants of the City of Little Canada. <br />2101.020. LAND DEDICATION FOR PUBLIC USE. In all subdivisions, as <br />defined by Minnesota Statutes 1980, Section 462.352, for residential, <br />commercial, industrial or other uses or as a planned unit development which <br />includes residential, commercial and industrial uses, or any combination <br />thereof, where the City Council deems it appropriate, a reasonable portion of <br />each proposed development shall be dedicated to the public for public use as <br />parks, playgrounds, public open space or storm water holding pond areas, or, at <br />the option of the City, the person or firm proposing the development shall <br />donate to the City an amount in cash in lieu of land. The City Council in <br />determining the reasonable portion to be dedicated to the public may take into <br />consideration the open space, park, recreation or common areas and facilities <br />which the developer has provided for the exclusive use of the residents of the <br />development. The portion of the total area which becomes dedicated pursuant to <br />these provisions shall be in addition to that land dedicated for streets, <br />alleys, easements and other public ways. No areas may be so dedicated for <br />public use without first having been approved by the City Council as suitable <br />for the public purposes enunciated in Section 2101.010 herein. <br />1. If the City Council, at its option, requires the developer to <br />dedicate land, a maximum of 10% of the total area to be subdivided shall be <br />dedicated for public use as parks, playgrounds, open space or storm water <br />holding pond areas. <br />2. If the City Council, at its option, requires the developer to donate <br />cash in lieu of land, the following criteria shall be applied: <br />1 9 <br />
