(a) The developer shall donate that dollar value of the <br />tract to be subdivided for residential use which <br />corresponds to the applicable density of the <br />subdivision in the following schedule: <br />Gross Density <br />0 — 2.0 <br />2.1 — 3.0 <br />3.1 — 4.0 <br />4.1 — 5.0 <br />5.1 or more <br />Dwelling Units Per Acre <br />Dwelling Units Per Acre <br />Dwelling Units Per Acre <br />Dwelling Units Per Acre <br />Dwelling Units Per Acres <br />Gross Donation Per Acre <br />3% of fair market value <br />4% of fair market value <br />5% of fair market value <br />6% of fair market value <br />10% of fair market value <br />(b) The developer of any land which is presently zoned <br />for single family dwellings and already has one or <br />more single family dwellings situated thereon, shall <br />receive a credit or credits for the existing dwellings <br />by excluding that occupied portion of said land from <br />the computation of dwelling units per acre as provided <br />herein. <br />(c) The developer of any land which is to be developed for <br />commercial or industrial use shall donate an amount of <br />cash equal to ten (10 %) percent of the fair market <br />value of the undeveloped land. <br />2101.030. LAND APPRAISAL. In those cases in which the City Council <br />requires a cash donation as provided herein, the value of the land shall be <br />determined by a competent land appraiser selected by the City. For the purposes <br />of this Section, such a determination of the value of the undeveloped land shall <br />be conclusive. Any costs incurred by the City in determining the fair market <br />value shall be paid by the developer. <br />2101.040. RESUBDIVISION CREDIT. In the development of any parcel of <br />land which previously has been subdivided and previously subjected to a cash <br />donation pursuant to this Chapter, the amount of such cash donation previously <br />received shall be a credit against any new donation required for resubdivision. <br />2101.050. PARK CHARGE FOR INDIVIDUAL DWELLINGS. <br />1. Recognizing that additional residential dwellings not part of a <br />subdivision, also create a need for public parks, the Council declares that this <br />Chapter shall also apply to single family dwellings and multiple dwellings to be <br />constructed, providing that such dwellings are not located in a subdivision <br />which has already been subjected to the park charge pursuant to the provisions <br />of this Chapter. <br />
