ORDINANCE NO. 179 AN ORDINANCE AMENDING SECTION 924.010 OF THE LITTLE CANADA MUNICIPAL CODE BY ALLOWING FOR COUNCIL DISCRETION IN WAIVING REQUIREMENT OF OCCUPANCY PERMIT, AND SECTION 924.020 TO INCLUDE LANDSCAPING APPROVAL FOR OCCUPANCY PERMIT ISSUANCE. THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the Municipal Code of Little Canada, Section 924.010, is hereby amended to read as follows: "924.010. Except for farm buildings, no building or structure hereafter erected or moved, or that portion of an existing structure or building erected or moved shall be occupied or used in whole or in part for any purpose whatsoever until a certificate of occupancy shall have been issued by the Building Official stating that the building or structure, including landscaping, complies with all of the provisions within this ordinance. The City Council may, at its discretion, waive the requirement of an occupancy permit when it determines that special circumstances exist which would otherwise result in a hardship." Section 2. The Municipal Code of Little Canada, Section 924.020, is hereby amended to read as follows: "924.020. Application. Said certificate shall be applied for coincident with the application for a building permit, conditional use permit, and /or variance and shall be issued within ten (10) days after the Building Official shall have found the building or structure and the landscaping satisfactory at the time of the final inspection. Said application shall be accompanied by a fee as established by City Council resolution." Section 3. This ordinance shall take effect and be in force from and after its passage and publication.
