STREETS AND SIDEWALKS <br />SUB -BASE. The portion of the street lying between the base and the subgrade. <br />SUBGRADE. That portion of the street which is the foundation for sub -base, <br />base and surface. - - -- -- <br />501.030. BUILDING PERMIT ISSUANCE. No building permits will be issued for any <br />construction within the village unless the building site is located adjacent to an <br />existing street which is dedicated and maintained as a village street, or unless <br />provision for street construction has been made in full compliance with this Code <br />and in no case until grading work as provided herein has been completed and certifie <br />to the clerk by the Village Engineer; except that in isolated instances the Council <br />may enter an agreement with a property owner for special handling of an unusual <br />situation which agreement shall be recorded so as to run with the land affected. <br />501.040. REQUIREMENT OF BUILDING PERMIT. Before any improvement, construction or <br />alteration of any kind whatsoever is undertaken within the limits of a right of way, <br />the person proposing such improvement, construction or alteration shall procure a <br />permit therefor from the village. <br />501.050. STREET IMPROVEMENT PETITION FORM. All requests for street construction, <br />improvement or re- construction shall be initiated by a request to the council upon a <br />street improvement petition form. The form of petition shall be available to the <br />public at all times at the office of the Village Clerk or the Village Engineer. Such <br />petition, when properly executed, shall be.filed with the Village Clerk. <br />501.060. PRELIMINARY REPORT BY ENGItE ER. Upon receipt of a street improvement <br />petition, the Clerk shall present same to the Council. All such petitions, before being <br />acted upon by the Council, shall be referred to the Village Engineer for preliminary <br />report as to feasibility of the improvement, as to whether it should be made as proposed <br />or in connection with some other improvement, and as to the estimated cost. When the <br />engineer's report has been received, the Council shall determine whether such improvement <br />is to be made and how it shall be financed. If the Council determines that the improve- <br />ment shall be financed by assessment against benefited property, all further proceedings <br />shall be in accordance with the provisions of Chapter 398, Laws of 1953, as amended. If <br />the Council determines that the improvement is to be financed by means other than <br />assessment of benefited property, all further proceedings shall be in accordance with <br />Section 501.070. <br />501.070. DEPOSIT OR SURETY BOND. (A.) When the street improvement will not be <br />financed by assessment, a copy of the engineer's preliminary report shall be furnished <br />to each petitioner. The petitioner or petitioners shall deposit with the Village an <br />amount equal to ten percent (10 %) of the preliminary estimate. This sum shall be used <br />to defray expenses incurred by the Village Sir plans, specifications, legal services, <br />advertising, or any other expense in connection therewith. In the event the work is <br />not ordered by the Council, any money remaining in such ten percent (10 %) deposit after_ <br />expenses as above specified have been paid, shall be refunded to the petitioners. <br />(B) After the petitioners have paid the deposit required in (A.) of this section, <br />the Council shall instruct the engineer to prepare final plans and specifications and <br />
