Mr. Dick McNamara <br />October 22, 1981 <br />Page 2 <br />I would like you to explain to me who would be liable for damages in <br />the following situation, and which of the situations would be covered by <br />our City insurance policy: <br />1. An unpaid coach is injured during a practice. <br />2. A paid coach is injured during a practice (can a 51.00 salary <br />paid by the City automatically make that coach a City employee ?) <br />3. A paid instructor is injured during a practice. <br />4. A 'child whose parents signed the registration waiver is injured, <br />eg. hit by a ball, hockey puck, slips on the grass. <br />5. A L.C.R.A. member is injured during a fund - raising activity on <br />City property. <br />6. A L.C:R.A. member is injured during a fund - raising activity on <br />property used by the City, but not City - owned. <br />7. A L.C.R.A. member is injured during a program or meeting <br />(meetings are usually held in the Little Canada Fire Hall <br />which is owned by the City). <br />8. A part -time employee is injured maintaining the facilities <br />(not City owned). <br />9. A customer or participant is injured during a fund - raising <br />program on City property. <br />10. A customer or participant is injured during a fund - raising <br />program on property not owned, but maintained by the City. <br />If the above situations aren't covered by our policy, what is the <br />best way to assure coverage? Would all the coaches, participants, etc. <br />have to be named each season in our City policy? Would a legal agreement <br />between the City and the L.C.R.A. be helpful for the City to assume <br />liability during City programs operated by the L.C.R.A.? <br />Please advise me of the answers to these questions so that I may <br />relay the information to the other parties involved.
