ENTERING THE METROPOLITAN AGRICULTURAL PRESERVES PROGRAM DIRECTIONS FOR COMPLETING THE THREE -PART APPLICATION FORM (OCTOBER, 1980) * * * * * * * * ELIGIBILITY OF YOUR LAND The eligibility of your land must be determined even before you can sign up for the Metropolitan Agricultural Preserves Program. Your local "Authority" has a primary role in this procedure. The Authority is the unit of government exercising planning and zoning authority in your area. If your land lies within municipal boundaries, the Authority is always the city. If your land is in a township, the Authority could be either the county or the township. Your local Authority must have an adopted plan that the land will be used for long -term agriculture (eight or more years), must have a zoning ordinance specifying a density of not more than one residential unit per quarter /quarter section (one per 40), and must certify these actions by formal resolution. In addition to this role for the local Authority in determining eligibility, there are certain acreage requirements for your land to be put into agricultural preserves. It must consist of: a. at least 40 acres, b. parcels of at least 10 acres each, to achieve a minimum of 40 acres, and be farmed as a unit, c. 35 acres (if a single quarter /quarter parcel) if due to a public right -of -way or survey system perturbation, or d. 20 acres which meet the conditions of Minn. Stat. 473H.03, Sub. 4. When your land meets the acreage requirement and is declared eligible by your local Authority, the Authority will fill out an affidavit attesting to its eligibility as part of the application process. (See section on Attachment B, below. ) THE APPLICATION PROCESS AND FORM The application form consists of three parts: 1. The Restrictive Covenant (AG- 00869 -01), 2. "Attachment A" - "Application for Initiating Placement of Land into a Metropolitan Agricultural Preserve" (AG- 00870 -01), and 3. "Attachment B" - "Affidavit of Authority (AG- 00871 -01). All three parts of the application must be correctly completed before the preserve can be established.
