Before Completing the Application 1. It is recommended that you confer with your attorney about your decision to enter the Metropolitan Agricultural Preserves Program. 2. Get an accurate legal description of all the land you intend to have designated as agricultural preserves. You can probably use the description in your deed for this purpose. 3. Determine who must sign the Restrictive Covenant and Attachment A. a. If the land is owned by a single, unmarried individual, only the individual must sign. b. If the landowner is a Vendee on a Contract for Deed, the Vendor(s) must sign as well as the Vendee(s). The Vendor is the person who sold the land, and the Vendee is the person who bought tie land and is making payments. c. If the land is owned in joint tenancy or "in common" with others, all of the Owners must sign. d. Your attorney should verify whether additional signatures are needed. For example, is this a Family Farm Corporation? 'Are there any guardians or conservators? e. If the land is owned by a married couple, both the husband and wife must sign. 4. If your land is registered Torrens property, have your Owner's Duplicate Certificate of Title with you, ready to present to the Authority with your application. 5. Find out from your Authority the amount of the application fee. The law states that local Authorities may charge up to $50 for administrative costs. Completing the Application Step One: Complete Attachment B, Affidavit of Authority (AG- 00871 -01): - 1. You must type in the complete legal description of all the property you intend to include in the agricultural preserve in Item (3) of Attachment B. 2. Take Attachment B to your local Authority and have the representative complete the rest of the items on the affidavit. Step Two: Complete Attachment A, Application for Initiating Placement of Land into a Metropolitan Agricultural Preserve (AG- 00870 -01): You must complete items (1) through (8) of this part. Item (1) Type or print the name (or names) of the Owner, or if a Contract for Deed, the Vendee's name and address.
