In the right hand column, check off whether the Owner is an <br />individual, legal guardian, Family Farm Corporation, or if none of <br />these, specify other arrangement. <br />Item (2) If the land is subject to a Contract for Deed, type or print the <br />name and address of the Vendor. <br />Item (3) Check appropriate box. <br />Item (4) Check off the acreage requirement which describes the eligibility <br />of your land. Forty acres will be the minimum requirement for <br />most people; they will check the first box. But the law provides <br />for certain exceptions of parcels smaller than 40 acres. If your <br />parcel of less than forty acres qualified for preserve status, <br />check which exception allowed the land to qualify. <br />Item (5) Enter the total number of acres included in the application and <br />described in the legal description. <br />Item (6) Check here whether the property is described by an abstract or is <br />registered Torrens property. If Torrens, include your Owner's <br />Duplicate Certificate of Title. This will be returned to you <br />later. <br />Item (7) Sign and date the application here. All Owners named in Item (1) <br />must sign. <br />Item (8) If the land is subject to a Contract for Deed, you will have <br />entered the name of the Vendor in Item (2). Have this person sign <br />his name and enter the date in Item (8). <br />(Items (9) and (l0) will be completed by the Authority later. Do not fill <br />these out.) <br />Step Three: Complete the Metropolitan Agricultural Preserves Restrictive <br />Covenant (AG- 00871 -01): <br />This is the primary document of the application for agricultural <br />preserves status for your land. Through it you agree to keep the <br />land in agricultural use as long as it is a preserve. The <br />agricultural preserve designation runs indefinitely and with the <br />land, not with the current Owners. The land can be bought and <br />sold, but the preserves designation goes with it until the <br />expiration. (The expiration of the designation does not begin <br />until you notify the Authority on Form AG- 00872 -01, or until the <br />Authority notifies you on the same form. The expiration of the <br />agricultural preserve status for your land is not final until <br />eight years from the date notice is first given.) <br />3 8 <br />
