LEAVING THE METROPOLITAN AGRICULTURAL PRESERVES PROGRAM DIRECTIONS FOR COMPLETING THE NOTICE (OCTOBER, 1980) * * * * * * * * When land is to be removed from metropolitan agricultural preserve status, the "Notice for Initiating Expiration of a Metropolitan Agricultural Preserve" (AG- 00872 -01) must be completed. This is a dual purpose form, usable by either the landowner or the Authority for initiating the eight (8) year expiration period on a metropolitan agricultural preserve. You, as the landowner, may give notice through this instrument at any time, and may choose to remove only a portion of your land from agricultural preserve status. The Authority cannot use this form to initiate expiration until the planning and zoning is changed to allow more than one residential unit per forty (40) acres, the land is formally decertified (made ineligible) by resolution, and the decertification is published in a local newspaper. The first five items in the form must be filled out whether you, as the landowner, or the Authority initiate the action. Item (1) Type or print the name (or names) of the current Owner, or if a Contract for Deed, the Vendee's (buyer's) name and address. In the right -hand column, check off whether the Owner is an individual, legal guardian, Family Farm Corporation, or if none of these, specify other arrangement. Item (2) As in the application, if the land is subject to a Contract for Deed, type or print the name and address of the Vendor (seller). Item (3) Check whether the land is described by an abstract or is registered Torrens property. Item (4) Type or print here the complete legal description for the land to be removed from preserve status. This may be all or only a portion of your property in the program; so the legal description here may not necessarily be the same as the one used in the application process. Item (5) Enter here the total number of acres described in Item (4). Landowner - Initiated Expiration If you, the landowner, initiate the expiration of the preserve, you must fill out the next two items. You ignore Items (8) and (9).
