Although <br />our client referred your letter to us for response some time <br />ago, my schedule has precluded a response any sooner. I <br />apologize for the delay, and assume full responsibility for <br />it. <br />On or about July 29, 1983, Mr. McCumber met with Mr. Jackson, <br />the abutting property owner, and as a result of that meeting, <br />Mr. Jackson agreed that a chain link fence would be acceptable <br />to him if it was screened. Mr. McCumber, acting in good faith <br />and in reliance on his agreement with Mr. Jackson, had the <br />slatted chain link fense installed at quite a significant <br />expense to him. It should be noted that the wooden fence <br />which had blown down was actually erected by Mr. Jackson's <br />contractor with Mr. McCumber's permission, in lieu of the <br />chain link fence original proposed and accepted by the City <br />in the spring of 1980. We assume that this matter can now <br />be considered resolved.
