SWEENEY, O'CONNOR & LeMAY
THOMAS M. SWEENEY
JAMES J. O'CONNOR
JOHN H. LeMAY
GEORGE F. BORER
Mr. Joseph G. Chlebeck
City Clerk
515 Little Canada Road
Little Canada, MN 55117
PROFESSIONAL ASSOCIATION
ATTORNEYS AT LAW
(612)2222541
November 16, 1983
Re: Gervais Lake Delinquent Tax Lot
Our File No. 5035
Dear Mr. Chlebeck:
SUITE 350
NORTHERN FEDERAL BUILDING
SIXTH AND WABASHA
ST. PAUL, MINNESOTA55102
NOV 17 1183
CITY OF
LITTLE CANADA
0
It is my understanding that the City is interested in
acquiring title to certain property in the City described as Lot
12, Block 2, Gervais Shores Addition. There are two methods
whereby the City can acquire to this property, and I will
describe both methods in this letter.
This first way the City can acquire an interest in this
property is to apply for a deed for public use purposes. This
would mean that the City would hold title to the property subject
to the public use, and it could not be resold. If the City
wishes to acquire the property for such public use, I have
prepared a sample Resolution and Application and enclosed them in
this letter for completion. The City should determine what
public use it wishes to put this property to, and fill in that
information on both the enclosed Application and Resolution. The
original Application and a certified copy of the Resolution
should then be returned to me and I will forward them to the
Office of the Ramsey County Land Commissioner. Minnesota Statute
provides that this process must be completed within ninety (90)
days of the request of classification as non - conservation
property. My file indicates that this request was made by the
Office of the Land Commissioner on October 24, 1983.
The other method of acquiring title to the property is to
purchase it at the appraised price as determined by the Office of
the Ramsey County Land Commissioner. If the City decides to
purchase the property, it roust pay the appraised price, and it
would also have to commence a Proceeding Subsequent Action to
clear title to the subject property. I have prepared and
enclosed a sample Resolution and Application for preparation if
the City decides to purchase the property on an unrestricted use
basis. If the City decides to purchase the property under this
method, it could resell the property at a later date after it has
41
