This property has a history of auto - related uses occurring on the site. In 2012, <br />the property owner was issued a CUP for two Indoor Vehicle Motor Sales <br />businesses at this location. At that tine, city staff did not indicate that one of the <br />new businesses also conducted auto - repair major because this was a use that <br />already existed with another auto - repair business in the building. However, in <br />reviewing the code, auto - repair major is allowed by CUP. As such, staff should <br />have included that as part of the approval. Therefore, staff is recommending this <br />be included as part of these amendments to further confirm all the uses on the <br />site. <br />• Renewal of lapsed CUP for Storage Containers. <br />A CUP was issued in March 2012 for up to three storage containers in the <br />outdoor storage area on the east side of the building to be utilized for tenants of <br />the building. CUP 's must be exercised within twelve months from the date of the <br />approval, or the approval will lapse. To this point the property owner has not <br />needed these containers and as such has not established said use on the property. <br />The applicant is requesting this approval be reestablished with the same <br />conditions as before which stated the shipping containers must be maintained in <br />accordance with the above provisions of the ordinance and subject to approval by <br />the Fire Marshal of the location and layout within the storage area. <br />An additional request of the property owner is to allow more than one year to <br />establish the storage containers. The reason for this request is that he does not <br />want the containers to become permanent fixtures on his property, but rather only <br />on the site based on the current needs of his tenants. To date, his tenants have not <br />needed the containers. Staff considers this a reasonable request and appreciates <br />the consideration of the property owner to keep the site neat and orderly. As such, <br />staff recommends the property owner be allowed up to three years to establish the <br />storage container use before the permit would lapse. At which time, if the <br />containers have not been established prior to the lapse in the permit consideration <br />could be given to extend before that deadline. This allows staff an opportunity to <br />review the current storage needs and compliance on the site without given <br />indefinite approval. <br />Below are the CUP code requirements for storage containers (same as the <br />existing permit) — <br />When storage or shipping containers are utilized, the following regulations <br />shall apply: <br />a. Containers shall be those manufactured expressly for the purpose <br />of storing and /or shipping materials. <br />
