located within the building. It would be staff's opinion that given the <br />number of vehicles already parked and stored on the site that the "rental" <br />storage complies with this provision. Additionally, because the IUP's <br />intent is to allow a property owner in the 1 -1 zoning district the ability to <br />rent storage to another business in the same district, it would then not be <br />for storage of personal items. Staff would require removal of the party <br />buses and personal automobiles as they are not associated with the <br />asphalt business. The off-site storage would be tied to the business <br />storage items. <br />3. The owner of the storage material owns and operates a business (the <br />"operator ") in Little Canada zoned 1 -1. <br />The current "rental" storage situation complies with this provision and it <br />would be staff's recommendation that any future "rental" storage comply. <br />4. The location of the off -site storage is zoned I -1 (the "off-site location "). <br />The current "rental" storage situation complies with this provision and it <br />would be staff's recommendation that any future "rental" storage comply. <br />5. The storage area meets all of the conditions for outdoor storage listed in <br />Section 914.040.G as if it were accessory to the principal use on the <br />subject parcel, with the exception of 914.040.G.4 of this Ordinance. <br />The current "rental" storage situation complies with this provision and it <br />would be staff's recommendation that any future "rental" storage comply. <br />6. Both the operator's parcel and the off-site location are found to be in full <br />compliance with all applicable zoning regulations at the time of <br />application, and have had no history of zoning violations in the previous <br />twelve (12) months. <br />Staff is not aware of any past or current violations with either parcel. <br />7. The owner of the property and the owner of the storage material execute a <br />development agreement with the City specifying any additional conditions <br />for use and operation of the storage area, including a termination date for <br />the interim use permit not more than five (5) years from the date of <br />approval. <br />With the above changes being made to the permit, it would be staff's <br />recommendation that the Development Agreement be between the City and <br />the owner of the property. This allows the property owner the ability to <br />change "renters" within the five year period without having to apply for a <br />new permit. Additionally, it gives some flexibility within the IUP for <br />whom the renter of storage would be, but the above condition that the <br />storage may not be utilized for storage of motor vehicles or parts of motor <br />vehicles would be included as a condition. <br />• CUP for Auto - Repair — Major <br />
