Improvement Project 81 -15 <br />(4640) <br />PURCHASE AGREEMENT <br />We, the undersigned, hereby acknowledge receipt from the <br />CITY OF LITTLE CANADA, a Municipal corporation, of the sum of <br />$5.00 as earnest money on account of the grant by us to the CITY <br />OF LITTLE CANADA, its successors and assigns, of permanent <br />drainage easements and temporary construction easements over, <br />across and under the following tract of land lying within the <br />CITY OF LITTLE CANADA, County of Ramsey, State of Minnesota, <br />described as follows, to -wit: <br />(See Attached Exhibit "A ") <br />(1) The undersigned, their heirs and assigns, hereby grant <br />the CITY OF LITTLE CANADA and its agents the right to enter upon <br />the above easements for the purpose of constructing said <br />improvement immediately upon payment of the total purchase price <br />as set forth in paragraph (2). <br />(2) The total price for said easements shall be the sum of <br />$453.70 of which $5.00 has been paid as aforesaid, and the <br />balance shall be payable as soon as marketable title has been <br />established and an executed easement in writing tendered and <br />recorded. <br />(3) The CITY OF LITTLE CANADA agrees to pay in addition to <br />the purchase price set forth in paragraph (2) an amount not to <br />exceed $800.00 to the property owners, in the event that certain <br />trees are removed in the course of construction of LITTLE CANADA <br />Improvement Project 81 -15. The specific trees are a four clump <br />maple, 35 feet high, a green ash, 15 feet high, and a poplar, 65 <br />feet high. If all of these trees are not removed during the <br />course of construction, the parties hereto agree to negotiate an <br />amount less than $800.00 as the purchase price of the trees that <br />are removed. <br />(4) We agree to promptly supply an Abstract of Title or <br />Registered Property Abstract showing marketable title in us <br />provided, however, that the CITY OF LITTLE CANADA shall pay any <br />costs for any continuation of said Abstract or preparation of the <br />Registered Property Abstract. <br />(5) If the premises are encumbered, we agree as part of the <br />above consideration to obtain the consent of the mortgagee or <br />other encumbrancers. <br />-1- <br />
