(6) If title is not marketable and cannot be made <br />marketable within ninety (90) days, or if any encumbrancers shall <br />refuse to consent to or fail to join in said easements, than at <br />the option of the CITY OF LITTLE CANADA, this Agreement shall be <br />null and void and any earnest money paid hereunder shall be <br />refunded. <br />(7) The easements to be granted shall be prepared by the <br />CITY OF LITTLE CANADA at its own expense and shall include the <br />perpetual right of said CITY OF LITTLE CANADA, its successors or <br />assigns, to construct, maintain, operate and repair the storm <br />drainage improvement as shown on Exhibit "A" over, across or <br />under the strip of land hereinbefore described together with <br />perpetual easement for ingress and egress on said property, all <br />without additional compensation. <br />Dated this <br />STATE OF MINNESOTA) <br />(SS <br />COUNTY OF RAMSEY ) <br />day of , 1983. <br />Kathryn M.
