NORTHWEST ASSOCIATED CONSULTANTS INC. <br />MEMORANDUM <br />TO: Little Canada Planning Commission <br />FROM: David Licht <br />DATE: 29 September 1983 <br />RE: Zoning Ordinance Revision - Convenience Groceries /Gas/ <br />Food Establishments <br />FILE NO: 758.09 - 83.39 <br />The Speedy Market canopy proposal has surfaced the question as to the <br />adequacy of the present Zoning Ordinance's coverage of convenience retail <br />facilities which sell self -serve gas, groceries and carry -out prepared <br />food. We advised the Council that we have recently looked into this matter <br />for the City of New Hope and were subsequently directed to provide you with <br />a copy of our work. <br />In essence, the Council is asking you to evaluate two items. First, should <br />the present Ordinance provisions governing convenience stores with gas opera- <br />tions be updated. Second, either as a related natter or independently, <br />should the Zoning Ordinance be amended to allow canopies for gas sales <br />facilities as a required yard encroachment. Within the context of the New <br />Hope Ordinance format, the primary factors judging the acceptability of a <br />canopy encroachment as a conditional use permit is the specific clause which <br />addresses this matter, plus the general "catch -all" conditions of Section <br />921.010.0 which read: <br />"1. The proposed action has been considered in relation to the specific <br />policies and provisions of and has been found to be consistent with <br />the official City Comprehensive Land Use Plan. <br />2. The proposed site is or will be compatible with present and future <br />land uses of the area. <br />3. The proposed site is or will be compatible with present and future <br />land uses of the area. <br />4. The proposed use will not tend to or actually depreciate the area <br />in which it is proposed. <br />5.
