page <br />Personnel Ordinance <br />(b) Hearings ReqUired: • <br />1. In cases involving dismissal, demotion, or suspension, the employee <br />shall have ten (10) days (excluding weekends and holidays) following receipt of <br />the City Council's written notice of action to file a written request with the <br />City Clerk for a hearing before the City Council. If the employee does not <br />request such a hearing within such seven day period, he will be deemed to have <br />waived such right and the original decision of the City Council shall be final <br />and not subject to further review. <br />2. The hearing shall not be held later than ten (10) days from the date <br />of filing of the employee's written request for a hearing. The Council will issue <br />a written decision to the employee within 10 days following the hearing. All time <br />periods herein shall exclude weekends and holidays. <br />3. If the employee is not satisfied with the decision of the City Council, <br />following the hearing, such employee may request an independent review of the matter <br />by application to the public employment relations panel as provided by Minnesota <br />Statutes, Section 170.78/ as amended. <br />4. The rights of any employee/ if such employee is exonerated and reinstated <br />to such employee's former position, shall be retroactive to the effective date <br />of the disciplinary action. <br />Sec. 21. Political Activity. <br />(a) Any employee is not precluded from becoming or continuing to be a member <br />of a political club or organization or from attendance at a political meeting or <br />enjoying entire freedom from all interference in casting such employee's vote <br />or from seeking or accepting election or appointment to public office. <br />(b) Any employee who becomes a candidate for or is elected or appointed to <br />any public office (other than a City Office) may be required to take a leave of <br />absence without pay and shall perform no duties connected with the position held <br />by such employee until such employee is no longer a candidate, or no longer holds <br />such public office, if such candidacy or public office interferes with such em- <br />ployee's normal duties of employment. If the needs of the municipal service <br />require the denial of a leave of absence and the employees candidacy or public <br />office interferes with such employee's normal duties, such employee may be re- <br />quired to resign or failing to do so, will be subject to dismissal by the City <br />Council. <br />(c) If an employee becomes a candidate for a position on the City Council, <br />such employee shall be required to take a leave of absence for the duration of <br />such candidacy. If elected or appointed to a City Council position, the employee <br />shall be required to resign from his previous position as an employee of the City, <br />of failing to do so, shall be dismissed from such position by the City Council. <br />
