MINUTES <br />PLANNING COMMISSION <br />MAY 11, 2006 <br />the pipeline itself. The Planner indicated Chat the City has a Pipeline <br />Policy that requires additional setbacks from pipeline easements. <br />However, this Policy was only adopted a couple of years ago. <br />Knudsen indicated his feeling that a hardship does exist in this situation as <br />outlined in the City Planner's reporC dated May 4, 2006. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Socha recommended approval of the Conditional Use Permit to allow the <br />expansion of anon-conforming structure as well as a Variance to allow a <br />front yard setback of less than 30 feet for 2367 McMenemy Street as <br />requested by Tonia and Brian Bevers based on the hardships that exist for <br />this property as outlined in the City Planner's report of May 4, 2006. <br />Motion seconded by Barraclough. <br />Motion carried 6 - 0. <br />AMENDMENT Mr. Lee Rossow appeared before the Commission requesting <br />TO CUP'S - Amendments to the Conditional Use Permits for his properties <br />194/196, located at 194/196 Ryan Lane, 3164 Ryan Lane, and 3175 Ryan Lane. <br />3164, AND 3175 Rossow reported that the current Conditional Use Permits for these <br />RYAN LANE - properties are tailored to his bus business, and he has moved most of this <br />ROSSOW business out of Ryan Industrial Park to 1870 Rice Street. Rossow reported <br /> thaC he would like the Conditional Use Permits for these properties Co be <br /> more generic in nature. His plans are to rent these properties to other <br /> businesses and would like some flexibility in the CUP's so that Chey do <br /> not have to be amended as renters change. <br />Rossow described each of his properties. 3175 Ryan Lane is currently <br />used as a special projects building for his bus company. However, this <br />property will eventually become a rental propet~ty. 194/196 Ryan Lane <br />had been used for bus parking. Buses will be removed and the property <br />rented to businesses that need car, truck, and/or equipment storage. <br />The building on 3164 Ryan Lane is of wedge slab construction and is <br />sinking. Rossow reported that in the next 2 or 3 years he would like to <br />remove this building and replace it with two buildings. He understands <br />that he will need a PUD to put two buildings on one piece of property. <br />Rossow noted that this is a large piece of property that has a pipeline <br />running right through the middle of it. The most efficient use of the site <br />would be to have two buildings on it. Rossow reported that in addition to <br />
