Smith also reported <br />that there are currently three families living in the Captette house <br />and a day care center is being operated in this house. Timmons asked what kind of gentleman's agreement there is for <br />maintaining the road and asked Mr. Smith how he felt about this. <br />Ctrs. Timmons asked Mr. Smith if he wanted the City to require a <br />road. <br />The Planner again pointed out that the City Council has stated <br />that before the lots in the area are developedsthere should be a <br />road and sewer. <br />Mr. Smith pointed out that there is the 15 foot easement going to <br />the property. Smith asked why he cannot use this for his driveway. <br />The Planner stated that the property is a landlocked parcel and does <br />not have adequate frontage on a public street. <br />`Ir. LeMay asked if a similar situation was not recently denied for <br />`(r. Chris Drake. <br />The Planner stated that the lot does not conform to City Code. <br />It's. Timmons commented that according to she Code a variance could <br />he ;ranted. 'Ir. Fasciana commented that he is requesting such a <br />variance. <br />"rs. immons stated that she Felt the road was needed, but that it <br />was not the pro5tem of this lot. Timmons pointed out that there <br />a 30 Foot driveway easement. <br />The "linner Stated that if the variance i.5 ; ranted tt should provide <br />t'iat the nocessary nronerty is dedicated for a public street .and that <br />the City may assess this property at the time that the sewer line is <br />installed. <br />'tr.
